If you are setting up an LLC yourself, it will most likely be an LLC without an Operating Agreement, no anonymity, and with you being personally listed as the registered agent.

I would strongly recommend having an attorney set up an entity for you, especially if you intend on holding a rental property in this LLC.

The main benefit of a land trust is that it provides property owner with anonymity. This is because with a land trust, the property’s owner is listed as the name of the trust itself, and your personal information is not associated with any public records related to ownership of your property. As the beneficiary, you retain full control of your property. You can manage it as you wish, rent it to others, or even sell it whenever you want. 

A land trust alone, however, does not provide limited liability, like an LLC would.

Normally you should be able to set up a virtual mailbox or a PO box in your name, and then use the address to set up the LLC.

Alternatively, you can have the LLC set up by a law firm that has an address they can use in your state.

I agree with Richard, if you plan on scaling, then a Series LLC would be a great options for you as it has unlimited scalability. Creating new series is a simple process that does not require any additional filings with the state. Additionally, each series receives complete liability protections while you avoid the cost of creating an entirely new company each time you acquire a new property.

If you do decide to form the entity yourself, I would strongly recommend you have an attorney draft the underlying documents for you - the operating agreement or bylaws, depending on the type of entity you choose.

Hi Josue,

From a legal standpoint I can say that there isn't anything different when it comes to establishing an LLC because you are overseas. However, depending on the purpose of the LLC and the type of business you plan on engaging with it, you may not be limited to Florida just because your residence is there.

I did have clients who had LLCs formed by a CPA, however, it is usually an LLC without an Operating Agreement, and with the client being personally listed as the registered agent.

I would strongly recommend having an attorney set up an entity for you, especially if you intend on holding a real estate asset in this LLC.

I would recommend a traditional LLC, ideally with anonymity, set up in the state where you plan on doing business.
