Dear Bigger Pocket members, i have a question and happy to get your experience, here is the situation, 

i have filed an eviction of paying rent for 1 month + costs , i have won the case and the tenant file for appeal, in that one she need to pay the rent for the court and also the coming rents until the trail.

Then i got a text saying i have paid the judgment but here are 3-4 fixes i had verbally talked to you and back month and those has to be fixed. (Running Toilet, Water does not drain fast in the sinks, front door is an interior door which i do not understand)

i am looking for some one who had an experience to tell me what should i respond to her for this text message as it obieselly the first time i hear it and second what is going to happen on the court date and what should i be prepared with ?

on the other hand, she has violated the contract by (1) not paying deposit installment (2) Pet Fees Deposit installment, she has not move the water bill under her name so i am taking the hit on that one, she didn't do renter insurance. and i am considering file another eviction in regardless the one that is going on which is on a different case for me.

happy to hear your thoughts on this lovely case.

@George Skidis, i am debating if i am obligate to do the move out inspection with the tenant or not 2 days before the hearing ? if i do the move out then there is no eviction record, if i don't do the move out the tenant can claim that he tried and i have not respond. any tips around that?

so if the tenant tell me he will move out one day before the hearing, should i cooperate and go ahead and do the move out inspection? or i have the right to say, you have not move out when i asked you for and therefore we continue the eviction hearing.

then i may risk to loose more time because the judge will give them another week and i need to bring the sheriff ? what is your POV ? the only thing i can get from the court is an eviction record on the tenant that does not contribute me financially so i may well corporate with the tenant. 

what are your thoughts ?

Hello, 

my tenant refuse to evict after pay and quite notice, i have filled an eviction suit and there is a court hearing scheduled, my tenant saying he will move out one day before the hearing so he won't have an eviction.

Questions:

1. do i have to do a move out with the tenant or i can wait for the court and ask the judge to evict him?

2. if i don't do the move out , will the judge perceive my un willingness to corporate? 

3. is it worth out just to do the move out - get the house instead of getting it lengthy in court ?
