You could chose to pursue monetary damages for the lack of notice, but it may not be worth your time and money to file.  I would only do it if you have a resident who wants to maintain a great credit score.

I’m going to lose a few months of rent because of this so I plan to go to court. It’s only a small claims court correct? Not much to file

I am in Buffalo NY. Tenant is month to month, lease states 60 day notice to end lease. Did not pay month of September. Did not give notice and said they will give me the keys on September 12. 
Can I enter the apartment at that time? Do I have todo an eviction? Do I go to small claims court to get my money for not following the lease?
