I try to file a complaint with the California Contractor Board. The contractor had threaten file lien on property or go to arbitraction (contract has a arbitraction clause) . he have not showed up to the job site for a month and asked for payment out of air. Please share your experience and advise. greatly appreciate it.

The property is selling $300k triplex, with rent $3800 per month. Insurance $1200 year, tax $5800 a year. I am not sure if the tenant pays any utility yet.

I am thinking the properties are appreciating, but still want to see how good the deal is. I never been a landlord before.

He just finished city rough inspection for last 3 months. Surprisingly he and his worker there today. And when he sees me he ignored me until I go in front of his face asked him of he could put up the shower wall higher with I pay him extra. Then he have his worker handed me a banch of receipts and an invoice for $25k( was asking for $12k).he basically ignore all the payment I made to him in the pass on this invoice(one check for deposit which not on the contract but he asked for it and one check was made for advanced payment for him to pay material which not on the payment schedule too), plus he claimed completion of some items which not completed into the invoice. Looks like he's still working, not sure what to do. I might be talking to my attorney again. One thing is how can I prove that the item he billed me has not been completed? I am sure he would complete it later day and puts me at fault or breach of contract not paying him later. I did took a lot of photos and try to have my realtor to come by as witness.

Karen, what do you think if I just fill the complain to the contractors board, and have them to resolve the issues with the contractor?

Thanks Aaron, I wouldn't want to sue people or complain to the board which might drag on months, but just want my peoject done. I will see how it goes next week.

Rough inspection with the city now, the project should have finished 2 months ago. I think I will wait to see what's next first. If he stops the work, I will have three contractors give me the estimate for what exactly we contracted.

Karen, it appeared to me the contractor moving his two workers arround in between his other job sites(I have seen them working one or two hours on my job and left without coming back), so I know he just TOO busy to work on the project. Sometimes he pretend they are there for the whole day or whole week while they are not. Thats why i said it might due to he just cant performAsoka can not be faster. so he made it difficult to me when I question WHEN he could finish. If I could be sure he would finish faster and work harder, I will definitely pay him right away to avoid the trouble. I hate confronting with people.

Aaron, the problem is he does not want to talk. Also I only seen him at the job site for 5 times and never intervened his worker or him. The main issue is not the money, or he would otherwise accept my offer of buying the material. Also I am not pointing finger or anything , I just want the project moving, and you might not understand the pain of paying all those maintainance fees while the contractor playing arround. I should have paid him in full weeks ago if he finish on schedule. The situation now is he's working on other jobs and can't get the project done, or otherwise he would work with me on what he needs to get the project done. $12k is not a small number, according to all other investors here, we should not pay in advance, especially on an non-performing contractor.

Jason, I didn't state the hours per week. Just a completion date. I will surely do that from next job. learn hard from previous two contractors. it just hard for me to believe that the contractor can just ignore what's in the contract and ask for considerable large sum of money. even he used all the money I gave him for the material as he claimed, he should still follow the contract, right?

There's no pre-lien yet as I know of. I starting to believe he try to delay the project by claiming unreasonable payment(at least according to the contract). And he would never answered my phones to get it resolved. He did told me he would continue the work with the material he has which I will see. But I strongly believe he would make it as slow as possible
