Hi all, thanks again for the advice

Here's an update-

I got a copy of the police report and it contains barely any information. The only thing that is relevant - "Caller states a male party is jumping around and is in pain. Ambulance requested. Transferred to FFD."

I was alerted to this entire situation from another tenant who has been trustworthy. Her boyfriend is a firefighter and said other firefighters (not him) responded to an OD at the property.

So what's going on? Did I get the correct report? When something like this is transferred to the fire department or ambulance personnel does that become a "medical" record and no way of me obtaining it? 

I'd call the tenants in question very street smart. Did they purposely report an OD this way as to not attract police attention? Or am I giving them too much credit and am overthinking it?

@Stephen E. I've been in the unit recently and they keep it in pretty good shape. I want them out as soon as possible and am willing to stomach winter vacancy but with strict Massachusetts eviction laws (also they have a child) I want to execute at the right time and hopefully mitigate risk of legal fees/tenant living rent free. With this in mind would it be worth it to just wait till April you think?

@Kiet N. lol I like that idea. One thing though - I don't know how much my tenant depends on it for income and for paying rent. They don't have a bank account. I make them pay by money order (which is always late and always a hassle to get)

Hi all,

I have a 3 unit multifamily in not the best area. One of my tenants has been complaining the past couple months that my inherited tenant has frequent comings and goings of people that look like drug fiends exhibiting drug fiend behavior such as banging on the door at very early/late times as if uninvited.

I haven't acted on it because I have no proof. But last night the police responded to an overdose at the property. 

Has anyone dealt with a situation like this? Does the overdose give me any leverage in working towards an eviction?

Evicting in the middle of winter in Massachusetts obviously isn't preferable - any advice as to aggressively pursuing eviction or maybe stalling?

Hi all,

Just closed on my first multifamily on Sept 6th. With rent already collected for the month of September, I was expecting 80% of that rent being sent to me (24/30 = 0.8). Having just received that check I come to find that all these extra fees have been deducted from the rent.

Total Sept rent: $1675

Fees from rent: 

Eviction court fees: $480
Management company fees: $120
Terminix, beehive: $189
Energy bill: $153
6 days rent: $334.98

Total: $1276.98

Total rent due to new owner: $398.02

I did not keep on the management company at the time of closing. So correct me if I'm wrong, but aren't all bills that occurred prior to the 6th not my problem and they shouldn't be deducted?

Hi all,

Currently in the process of acquiring my first investment property in Fitchburg, MA. It's not the best area and I want to position myself accordingly as to not be taken advantage of by troublesome tenants. 

All tenants are currently on annual leases. What are the pros/cons of switching to a month to month lease? Are there any laws in MA that prohibit me from not renewing a lease of a tenant that did not have any violations? Do I have to give notice to tenants that I do not intend to renew their lease next month?

How do you incorporate late fees on M2M leases? How do you structure security deposits and how do you account for the fact that you can't charge first/last months rent since it is not annual?

Any advice and information greatly appreciated!
