Hello, I’m a landlord in Minnesota. I’m about to turn tenants and I’ve scheduled my cleanings, maid service as well as carpet cleaning. My tenants have 2 cats. At one point in their 2 year tenancy my tenant was out of town and had their friend come to check on the cats. The tenant texted me to ask if I had anyone in the house (no) bc the door to where the cats litter box is was closed and they pooped all over the carpeted down stairs. (Probably your friend shut the door) Yuck. I’m getting the carpets cleaned at a discounted Groupon rate so the whole house is about $100, is it justifiable to pass the tenants the whole cost and not just the carpet where the cats pooped? I know the law states something like, security deposit is used for things for beyond reasonable wear and tear. What do you think about cleaning fees too? How do people generally pass on cleaning fees. Thanks everyone

If I itemized for my personal deductions on my 1040 and schedule E for my rentals, can I switch to take the $24k standard deduction on the 1040 while still itemizing on the schedule E under this new plan?

I really appreciate the start of this conversation and I will be watching this thread. I sent an email of questions to my financial advisor but with the new bill, I'm sure not everyone completely understands how it affects certain people. I understand the changes for the standard deductions but how does it affect (positively or negatively) us who take itemized deductions for our personal taxes and for our rental properties? Would it make more sense to LLC or Corp my "rental business" and keep my eligibility to take advantage of the large standard deduction (married filing jointly)? Anyone have insight to this?!

Hello, I have a boyfriend/girlfriend tenant situation where the boyfriend is accused/charged with a domestic violence incident. Minnesota has a law that protects DV victims where they can provide written concern to the landlord and basically get out of the lease. The statue says it "terminates the lease" and doesn't give back security deposit either. .... my tenants prepaid 6 months of rent which only applies to the last 6 month this of the lease terms. If my tenants lease is terminated, do I have to give back that money? I've discussed this with a lawyer, I am able to evict based on my zero tolerance for criminal activity addendum, but an eviction with a physically aggressive person doesn't sound like a great idea. I'm still awaiting the police reports. The statue: (b) In a tenancy with multiple tenants, one of whom is terminating the lease under subdivision 1, any lease governing all tenants is terminated at the latter of the end of the month or the end of the rent interval in which one tenant terminates the lease under subdivision 1. All tenants are responsible for the rent payment for the full month in which the tenancy terminates. Upon termination, all tenants forfeit all claims for the return of the security deposit under section 504B.178 and are relieved of any other contractual obligation for payment of rent or any other charges for the remaining term of the lease, except as provided in this section. Any tenant whose tenancy was terminated under this paragraph may reapply to enter into a new lease with the landlord.
