My nightmare began when a recent tenant failed to notify me of water damage. I discovered wet moldy carpet in the basement. Subsequent scoping of the main line (and multitudinous other testing) revealed 17 feet of standing water in the main sewer line underneath my property extending under the adjoining property. The HOA claims they deal with standing water in the main sewer line by bi-annual snaking of the line. They have no written record of having done this "maintenance", and even stated that my tenant refused to let them in to do it. They have never notified me of any such "maintenance in the 8 years I have owned the property. How can I get the HOA to properly fix (dig up and replace) that part of the sewer line?

Scott, Are you saying that an LLC is not worthwhile, since I'm thinking a pour over will would not pertain to property titled in an LLC? Thanks Murlie

Thanks to everyone for your input! Re Series LLC, I've heard it is a form that hasn't been tested much in courts so that's why lawyers tend to not use them. We didn't know what we didn't know and the lawyer in Utah (where we have one of out properties) uses them. It seems straightforward to make "series" within the Series, just need to register as foreign entity here in Colorado.

We are going to put our rental properties in a Series LLC. How do I pass the properties to my heirs? A Beneficiary Deed won't work because an LLC doesn't die. Does the Trust become a member of the LLC? Should it be the only member? If so, the LLC becomes a single member LLC which is less desirable than a multi member LLC. Your thoughts and advice appreciated.
