Post: Rent Increase after Tenant Non-Renews Lease

I own a single family house in suffolk county that for the past 3 1/2 years has been rented to a family of 4. Their current lease was for 18 months and expires July 31, 2023. They informed me that they will not be renewing their long term lease but are requesting a month to month one. I explained to them that because they are not moving out during the summer they are preventing me from getting new tenants prior to the school year starting so I have to raise the rent to market rate. Below is a copy of the email I received from them.
We consulted our attorney and per NY State Amendment to the Rental Laws (July 2019), tenants who have stayed as long as we have are to be provided 90-days from the time of notification to move out if rental increases are greater than 5%. Based on this law, our move out day should be 90-days from today, which is August 20, 2023. If we find another lease sooner and you wish to prorate the rental to provide a refund for unused days we can discuss.

Does this law apply even though the tenant is non-renewing?
