Post: Lien on Title, Seller Refuses To Clear

Hello all! I recently had an offer accepted on a home in PA. All was going well until the Title Search showed a lien from a credit card company. The seller stated that he would sell the property by a certain date because the credit card company would accept less money as a settlement if the deal closed by this date. This required me to close the deal in 17 days from the offer. Keep in mind my sales agreement gives me much more time. The artificial 'due date' was put forth by the CC company. It now seems we are going to miss that date by 2 days, and the seller now states that he will not clear the title and refuses to sell. I still have 20 days before my sales agreement's closing date. Do I have any options to force the seller to take action on the lien?? BTW, the early closing date is not in the contract and was only put forth as a favor to the seller if the mortgage could be done in time.

We recently went into contract with hopes to move in 3 weeks, but the seller is backing out. We received a call from his realtor saying that there he has a pre-payment penalty on his loan and that he has nowhere to live (his house has been on the market for 7 months and he didn't consider all this?...yeah right). The following day the realtor calls back saying that he first thought he couldn't get a loan but now he might be able to get one so then he was still going to sell it. Then today we received a ""cancellation of contract"". Can the seller do this? What are my rights and options?

1. Do plenty of market research or property evaluation in Costa Rica real estate before starting up any business in Costa Rica. The Tico consumer can be fickle, and a seemingly sure-fire bet may not be such a safe choice as you thought.

2. Be on lookout for con men, be aware of the differences between the legal systems of Costa Rica and your own country, and get a good lawyer.

Dont's

1. Pay bribes. It may or may not work out - but could easily end with your being deported.

2. Use an overly-aggressive sales pitch. This will really turn potential Tico buyers off.

A person I know of has been very successful listing commercial properties online over the past year in order to locate buyers. So successful that this person sold a few 5 million+ properties. This person has no licensing and has nothing to do with communicating with the prospective buyers or filling out paper work. They merely place ads in the owners name with the owners permission and receive a commission. All of the paper work has been done through the buyers broker and real estate lawyers. Is this something that is allowed in the US? Seems like it should be but I am just curious because this person seems to be doing very well.

If you know anything about us or read our stuff you'll know we’re DEFINITELY not saying this is the ONLY way to get started...but it is A way...and it does work...

When you first get started, you need massive movement. So search every where for real estate deals.
I would:

Get 3-5 brokers looking for property for you.

Call all the I Buy Houses ads in the paper and on road signs- find out what they're looking for...........
