it is a real property management company, “Renter’s Warehouse.” The owners live in Germany and their son lives here in the states. He translates for them. Thank you for your advice! Renters Warehouse have continued to ignore our requests for receipts and keep giving us the runaround. And now that you mention the above, I can only assume the girl that handles the security deposit is trying to cover it up. She knows she is in hot water for not handling it properly. 

Ned-We had to submit in writing our intention to move out along with a forwarding address. Even if they sent correspondence to the last known address, which was their house, it would have been forwarded to us. They had our new address. Sorry you had such a diffcult time with your tenant. 

Christine-they can put whatever they want on our credit just as much as we can put a lein on their porperty for what they owe us. They want to sell the home. We consulted with an attorney here in Vegas and we would come out on top. I hate for it to get like this but I think the property management company messed up. Our theory is there trying to take a vantage of us. So I would love for this to go in front of a judge because then I can talk to the owners and square things up with them.  We have zero contact with the owners at this point so I don’t even know if they are aware of the situation. 

 Anthony- The girl that handles the security deposit and the communication between the owners and office said she would give us “bids” not receipts for the jobs that needs to be done.  And that was four weeks ago so I know they don’t have proof of anything.  

Thank you for all the advice. I as well think it’s a mistake by Renters Warehouse. They know the laws here in Vegas and are trying to take advantage of us. 

I am wondering if it is better to make them chase me for money or chase them? 

I hear in small claims if one is awarded a judgment it is tough to get the money. I guess I could always pay the $2850, go to small claims for the $2286 and then place a lien on their property for the amount!? They want to sell the home. In all honesty I don't want to pay them anymore than I have to out of my pocket. I spent $1,000 + cleaning up this property and getting it move in ready. I went above and beyond for them trying to be nice and this is what I get in return. :(

They took two months to get back to us regarding the security deposit. This was 11/18/2018 and since then we have requested via email, verbally, and a certified letter requesting receipts of the so called "damage." We have been ignored until I left a bad review of the property management company on Yelp. They called me and said they would get those receipts to me. That as two weeks ago and nothing yet. We are in Las Vegas, Nevada. This is why we have not paid the $2,850 early termination fee because we know the place was spotless and they have no grounds to charge us the $2,286. they are blowing us off but I not only want to do the right thing but the smart thing. I need some savvy advice! Thanks everyone!

We moved out of our rental property early (by two months) with an agreement to pay $2,850 early termination fee. We have a refundable deposit of $2,700. We did a move out walk through with the property management company's realtor receiving a clean report and no damage stating the property was move in ready for the next tenants. They first told us we can apply the deposit return to the early termination fee and we would only owe the difference. We expected to get a bill for the remaining amount of $150. 

Three months later we get a notice stating we owe the $2850 plus they charged us all these unreasonable charges withholding $2,286 and refunding us only $414 via check! We had a consultation with an attorney and we have every right to ask for our entire deposit back. But we are not sure which road to take.

1. We can pay the $2850 and take them to small claims court asking for the remaining $2,286 of our security deposit back.

2. We can take the $2850 and subtract the $2,286 and only pay them the difference of $564 and see if they try to take us to court.

3. We can sit back and not pay anything to see if they take us to small claims court for $2,850 and counter sue for the $2,286 security deposit we owe. 

Not sure which avenue to take. Has anyone had any experience dealing with this? The property management company does not want to help us and for months we have been requesting receipts of this "damage" they claim we owe them that was deducted from the deposit and they have not given us anything. Help!
