Renter pays rent for 2 years and leaves all is well. You look at the house and the paint is a little faded. The carpet while clean is a little mashed down but all normal "Wear and tear". You realize you have to repaint and replace a carpet or two to continue to charge a premium. No big deal it's the cost of doing business.

Case one you spend a few bucks and are out renting it again.

Case two: You smell a hint of smoke and the lease says no smoking. You now have a security deposit to help replace that paint and carpet with and are out renting it again.

Hey James,

Not an expert or legal scholar by any means but my 2 cents.

If I "Knew for fact" it was Asbestos (Provable in court that I knew it was) I would contact a high end company specializing in removal and get their huge bid to have it removed.

If I "Thought it may be" or "based on age could be" then to me it is just old ugly tile to be removed and replaced. I would grab a standard contractor to rip it out and replace the floor. They "know how it works" and to them it's just a floor replacement job. Would put it at the price of a floor rip and remove. Once you specifically mention Asbestos to them you put them in a different place legally as well. In my experience it is the elephant in the room no one discusses when figuring contract bids and it just gets done.

Good to hear it is all moving along. Personally I wouldn't sweat the small stuff. If everything else about them works by the numbers, I'd add "no smoking on the property" to the lease and be done with it. Trying to cash in on a $50 fine may turn out to be a whole lot more trouble than it is worth. You may find yourself sneaking around and then arguments about when you can come on the property and courts and just a whole mess over a cigarette butt. Unless you plan on watching them like a hawk, if they want one, they are going to smoke (inside or out). I would say either rent to them and inspect the property when they leave and if there are problems recoup them with security deposit or don't risk it and deny their app. Judge the risk and run those numbers as opposed to trying to enforce a rule.
