 More so wholesaling at the moment. Thank you for the advice. I told the seller they should go through probate first. The probate court told me that even if the lady is unfamiliar with the process she will know what to do once she has gone through probate.

I have had a property under contract now for about 3 weeks now and it is supposed to be a wholesale deal however the price is not exactly where you would like to be. Problem is even after renegotiation's I may be too far in the contract. Are there any recommended methods or services that may be able to assist me in this before walking away from the deal? I just want to try everything before I completely give in...

p.s. I hate to give in. However im learning that many deals you find yourself involved in you just may have to walk away from.

the deed is of record.. and sure you can get a quit claim from who ever is on title now but no title insurance I suspect.

This Is a quiet title action with most likely skip tracing to find heirs etc.. these can take months or they can take years.

We find this very common in Charleston SC... I in fact just got one cleared up this week and we close on Friday I think I went into contract in May.... it was up to the son to chase everyone down if he wanted to get any money and he did.

The other one I have going is a full blown quiet title and an expensive one I figure to spend 2 years and 5k.. on this one.. with no guarantee of perfecting title.. but its a smokin deal and at my level risking 5k is fine.

Wow thats GREAT!!! I feel like this could be a great deal as well only problem is the seller is not very interested in selling if they have to track down all the family members who may potentially be involved. Said to me if probate cant appoint her as the executor where she can make the decision then it wont ever be sold.

Has the attorney run a title report? Can you buy title insurance? Do you know a good Real Estate attorney in GA?   

 Yes i have instructed the seller to go through probate and she agreed. As for the title I have not had the attorney run the report, Not exactly sure if the title insurance will be an option for me or not and I am very new in this business I know of 2 so far that I communicate with however I am open to any recommendations.

@Luis Montanez so in order for that to be possible they would have to go through probate first? Being that they have no rights to the property because all the papers that the parents had on the house have been lost. She said the father had a hand written will that was never filed ANNND she does not know where that is. She also stated that the family has branchedout in a major way and there is no way she can find everyone in states across the country. I'm starting to like your option 1.

Is there a way to go about closing a deal without the original deed? The owners/parents past away and the child is looking to sell. Been past over 10 years and never went to probate. The current executor has no executor paperwork and simply doesn't know where the paperwork is. No will was filled by the parents. A closing attorney told me to get ready for a very long process location the air's to all the parties who could possibly be involved. Is there anything I can do or recommendations?
