Qualified Tank Scanning was recommended to me by someone I trusted. Was thinking of going with ATS at the time. My broker said he’s only dealt with this kind of thing once or twice in 21 years. The property was tiny. Missing a tank on like a .15 acre lot is just unfathomable. It should never happen. This has to be the worst case for this size of house and property.

@Steve B. It was decommissioned, but it still had a leak and contamination. Total cost was $13,000+!!! Had to move about 22 tons of soil to remediate.

@Joe Splitrock We going after their insurance now. What a PITA! We had to delay closing and now I have to spend hours dealing with an adjuster. What a mess over something so simple!

Thanks.

The tank was pulled last week. Unfortunately, it had holes and there was contamination that has to be remediated. So far, we are looking at about $11,000 before landscaping to bring the property to prior condition. Now I have the fun work of chasing down the insurance company for payment.

@Tyler Weaver the oil tank was decommissioned in 2003 according to the town records. Hopefully, all the oil was removed appropriately.

Hi Mike,

This tank was in a completely obvious spot, they used a magnometer and they totally missed it somehow. The yard is tiny and the tank was right in line with the heating unit about 10-15 feet away. I’ve had three other people out, including the original company that did the scan and nobody can believe they missed it. So the “WHY” would be gross negligence.

I have reached out to an attorney, but I was hoping to get some additional wisdom from people who may have been through this.

I've already gotten my money back, but this is a much bigger issue.  

I relied upon their "expertise" in finding a tank before making my decision to purchase.  Had I known there was a tank I would have a) not purchased the property (I passed on several properties because I didn't want to deal with an oil tank) b) had the owners remove it at their expense or c) would have asked for a significantly discounted purchase price to account for the risk.
