Ryan Dossey she didn’t mail checks. She gave us 3 checks at a time post dated the 5th since day one. Once her checks bounced we asked for certified funds And returned her checks. She didn’t give us certified checks. She said there’s no need for that just cash my check. Talk about breathing slowly before snapping at her!
She’s just an ugly human being. She doesn’t get it. A contract is legal and she thinks she can have it her way. She wants to be in control but that won’t fly with us. We decided the trees didn’t need much attention as we thought. We can wait until she leaves in April. The front yard looks horrendous so there goes another note on negligence.
She did pay the rent and late fees. For March though, she changed the date from March 5 to March 3. Banks couldn’t cash it. So I told her I need another check right away or I’ll have to add late fees. Her response was just plain rude. “I will not pay a late fee! You have my checks and will have new checks if you come by now otherwise you will have them by 5:30 it’s not my problem if you don’t go to the bank. I’m happy to fight you in court my lawyer has all of your harassing emails. He wanted to take you to court last month I’m sick of your harassment. go to my bank and have them call me! You have the checks and have had them since last month”. Now, is this anyway to talk to a landlord that has helped you along the way? We allowed her to pay, one time, on the 10th due to her her new job and pay schedule. Not once have I harassed her. My emails have been courteous. Sent her a lease violation so maybe she thought that was harassment. I have everything in writing and her voicemail when she waited 5 days to call us for a water leak. That damaged our entire wood floors which we had to replace. No deposit given back for negligence. Yep, I can see her taking us to small claims for that one. She thinks that by adding “harassment” in every message that a judge will go her way.
Update: such a hassle with this person. All this just makes us want to quit rentals!!!
Update: luckily we have Legal Shield which gives us access to attorney advice at any time. I wanted feedback from actual investors so thank you all for your advice as well. He advised me that a postmarked check won’t suffice. Since she has until the 3rd and if we don’t receive the check that day (which we won’t since it’s a Sunday), then we can either wait until Monday’s mail or send her a notice to vacate. Either we lose Feb rent and evict or wait for check. A bit frustrated since she’s claiming I’m harassing her. Now she won’t let us on the property to trim trees. Yea a bit frustrated with this nutcase.
Live in Texas and have a minor setback with a tenant. She’s had two bounced checks so we asked to pay in certified funds for the remainder of the lease (3 mos). Her response: “I don’t have to. My lawyer says I don’t. I will pay with a check and I will mail it. Stop harassing me!” My concern is she will mail it on the 3rd and we won’t get until two days later and once we deposit it may or may not clear. What to do? Feeling trapped by a tenant. Any advice is greatly appreciated! Thx

Gary, what interest rate were you able to find? Debating on refi since there's so many fees involved. 

Eric, since you got a cash-out refi, do you find it difficult paying for that loan? I know you owned the house out right, but does that bring your cash flow to a minimum? We're going through something similiar. We own one house out right but need some cash on another potential investment but bank won't lend us anymore. I'd hate to get a loan on that house since all the rent is profit. Thx 

I haven't used hard money. Willing to try though. We used cash on some deals but are looking into a rehab now that needs a bit more cash. I hear hard money has higher interests rates because you won't be keeping property for long. Need more info on this.
