Post: New York Lender with no Refinancing period?

I recently did cash-out refinance with Amerisave without seasoning at 3.125%, 30 year, 2 points.  It took almost 3 months from the time I applied to the time I received the cash, so it was not a speedy process.

Thank you Rich and revinv for your advise. I will check with an attorney. I did not deposit the check and the prospective tenant wrote on the check itself "Pending application approval" The receipt I gave him also says the same. The applications asks if they have been convicted of any crime or misdemeanor other than traffic related of course they lied.
I guess we will not be eating at that restaurant again, our community is small at this rate we will not be eating out much. We evicted the delivery guy at the pizza place last year.

After meeting with many prospective tenants I decide on a middle age couple and their son. When I said I would run a credit check he let me know about troubles with IRS and child support but it seems to be way in the past. So I accepted a $900 deposit pending credit/background check. I almost did not even check the wife who I know because has been the manager at a local restaurant for the last eight years. Anyway, she was arrested in December 07 for possession of cocaine and driving with tags that did not belong to the vehicle. She was sent to jail for one day and now is on probation.
Do I have to explain why I am returning their money? Do I have to put it in writing or just tell them? I live in Florida.
