ok new update, I spoke with the Executor(sister of dead brother) today.  She said her attorney is stating that the house must go through Probate.  She said as the Executor she can not sale the house, the house mortgage is still current and only her deceased brother can sell the house at this present time. any thoughts on this?

its a standard house, the mortgage is paid up to date.  The Executor said she already told the bank to take back the house.  She gave me the lenders number, Quicken Loans and I am trying to call Quicken to ask about buying house directly.  Anything else I should ask Brett?

I am talking with an Executor of an estate about the house.  The relative just passed last month, the Executor said she planned to have Lender take back the house.  My questions:

Do I call the Lender and ask if we can purchase the house from the Lender?

or Do I call the Executor and tell her to keep paying the monthly payments for the Loan, and then buy the house directly from Executor?
