Post: What are the rules regarding shared walls?

Hello,

I am trying to figure out what to paint in my property, which has some shared walls made of stucco.

I have a front courtyard delimited by a dividing wall with one neighbor (to the right) and a combination of a dividing wall and a house wall with the other neighbor (to the left). That house wall is that other neighbor's wall. Can I paint that wall? The HOA wrote:

"Anything that needs to be painted from your side of the property, would be for you to paint. We cannot ask you to trespass onto a neighbor’s property, nor can they be asked to trespass onto yours in order to do any work."

That makes sense because he would not be able to paint that wall without trespassing onto my property. On the other hand, it is his wall, so I could potentially damage it. What is normally done in these cases?

Hello,

I am looking at the purchase papers and all I see is in the title a section called "exhibit A" that tells me that it is "Lot XX, as shown on the plat of <name of association> recorded in Book 26-B, recorded in Book YYY of Maps, Map No. ZZZ, records of said County." 

I contacted the planning division of the city this rental belongs to and they told me what they see in their documents, but they warned me it is just approximate. Where can I find a copy of the actual map?

Hello everyone,

I have been able to find that even though the tree is located between the sidewalk and the curb, the city has my property lot end at the back of the curb, and no other HOA property appear around my lot. So apparently, both the tree and the pavers are in my lot. I guess at this point, despite of your (and my!) hopes, it seems I will be responsible for the repair of the sidewalk that the city is requiring. If there are any other ideas out there, please share them.

The homeowners manual was really vague and just read: "The common areas and facilities that the Association is responsible to maintain include a four foot wide landscape strip on the residential lots which lies behind the garages, the streets, walkways, landscaping, etc." No idea what that "four foot wide strip" is.

Hello, although it is not the same, I would like to know if I am responsible to fix a sidewalk broken by the roots of a tree that is in HOA territory, in front of my property, between the sidewalk and the curb (got a notice by the city). Thanks!

@Clint Shelley: The tree is in front of my property, between the sidewalk and the curb. It doesn't belong to the city. It was probably planted by the developer.

I gave the city a call and a very nice manager in Public Works told me that any time they give these notices it is because somebody made a report of a trip hazard, they never look for those themselves. They also said I would need to check with the HOA. I plan to call them next, but by now, what I see in the CC&Rs is what I added to my previous post. I am positive that they maintain the landscaping and the front yards because I have it in my notes from long ago. Now, I am not sure about this particular case.

@Joe Splitrock: I am not given a choice to keep the tree, the work order includes a "tree removal and stump grinding." They said there are two organizations that will find for a replacement tree for me, if I want it.

@Julio Garcia: Thanks, and if they "push back," how do I proceed? I haven't contacted them yet, but I want to be prepared.

@Patricia Steiner: Thanks, so would you talk to the HOA at all or just write? I assume that for the city it is better to simply put it in writing?
