Post: Tenant put up security cameras, how to deal with this?

I had a nightmare tenant who put up security cameras so that when my process server came to serve him his 5 day notice for eviction he could pretend he wasn't home.

I am not yet licensed, so I cannot yet offer to manage others' properties, but I will ask around here in Naperville for recommendations.  Are they looking just to fill the vacancy, or full service PM?

I've been managing our own properties since 2012, and I want to make sure that the many hours I spend on our 8 properties are countable for the Real Estate Professional designation.  Can you help me sort out what seems to be some conflicting information from around the web, especially regarding the time I spend researching and whether those hours count?  (I am familiar with the requirements for 750 hours, no outside FT employment, and spending 500 hours on each activity, or as an aggregate).  I want to be sure that the following activities I am assuming I can count are, indeed, allowable.  

Research: For this I would include time spent browsing listings, driving around to prospective properties, neighborhoods, viewing comps, etc--Obtaining the background knowledge someone needs to evaluate whether a potential property is a good investment.  

Leasing: Advertising, communicating with prospective tenants, vetting their references, etc., visiting their current residences, time spent cross checking flagged areas on a credit/screening reports, etc.

Maintenance: Includes time spent fielding and responding to tenant requests, finding professionals to handle certain jobs, travel to the job site, time I spend performing repairs within my capabilities, time I spend cleaning a unit.

We have been advised that I should be receiving a W2 from our LLC, and that would give a clear signal to the IRS that I am a RE Prof. I am not so sure about that advice, but it is coming from an experienced realtor who assures us we should be doing it. We are currently interviewing a few different tax advisors, as we would like one who is more up to date with RE strategy and the changing laws.

We are entering the flipping market after several years of buy/hold RE investing.  Cook County, IL has a plethora of occupied foreclosure options, but I am hesitant to buy in Cook, which is notoriously tenant-friendly when it comes to evictions.  

I realize that an occupied foreclosure requires the buyer to evict the current occupants in order to obtain possession, so I am wondering if Cook County is better about evicting tenants when the property is foreclosed/sold than if the original landlord or lien holder is trying to evict the occupants.  Anyone with experience in this, either in IL in general, or more specifically to Cook Co?

We currently have 8 units, all local. Our portfolio is a combination of SFH and townhouses. We've been acquiring rental properties since 2012. We hope to start doing some flips as well to diversify our strategy.

EVICT!  Start yesterday.  Under no circumstances would I allow them to stay.  Do not accept a penny from them, as even partial payment could mess up your eviction proceeding. Evict now.

I'm not sure how far we want to pursue it.  The guy has a potentially violent, or at least threatening,  history.

Matt K., in reply to your good suggestion, this was our request to the tenant, but he insisted that he paid and QB goofed.  He claimed to be "working on it," and when we suggested meeting to collect cash or a money order he claimed he was out of town--a FAVORITE excuse of scammers.

You can request transcripts of a tax return to be sent to you from the IRS.  From the IRS' website: "To request an individual tax return transcript by mail or fax, complete Form 4506T-EZ, Short Form Request for Individual Tax Return Transcript. Businesses and individuals who need a tax account transcript should use Form Form 4506-T, Request for Transcript of Tax Return."

Victory in the courtroom today.  I'm not going to see a penny from this guy, but he has been ordered to vacate in 7 days.  Crossing our fingers that he doesn't or hasn't damaged the house.  

His evidence was just a screenshot of what he claimed to be his bank's mobile app.  No actual statements.  No bank name or his name on the screenshot.  Judge totally didn't understand what I meant about him altering the November payment email confirmation to show December, but the judge didn't believe him.
