 I am going to have to say 'safety and heath reasons' concerning the condition and habitability of the property/building itself.  The lease does not cover in any section a provision about crime, but does require us to provide a habitable space for our tenants...as we should.

What does the lease say? Do you have any prepayment exit clause? It is not uncommon for a tenant to claim breakins when they want to move out and very difficult to verify.  You could work out an agreeable move out plan with her paying some amount and letting you show the property ASAP.  Try to do a win/win if possible.  You may be able to get a month or two of rent to cancel the lease and ease the loss on your part.

 The lease provides us to basically mitigate our damages under the default clause.

Good afternoon everyone, 

I have a property that was broken into today according to my tenant.  She said the police were at the house.  This is a safe area and neighborhood as well.  I have not discussed the details of it yet with her, but she did say she didn't feel safe there any longer and insinuated that she wanted to break the lease via voicemail.  Keep in mind she wanted to break the lease a few months ago for different (nothing to stand on) reasons as well.  We need some advice on how to deal with this kind of situation.  I think she has about 3-4 months left on the lease.  Any advice would be appreciated.  Thanks in advance!

Agreed.  Insurance will cover only loss.  They will not provide preventative "maintenance". My advice is to take the tree down at your expense, especially since you know about the infestation.   This could come back to bite you if the tenant can prove you know they were bad trees.

Saved. Saved. Saved until I had 20% down (of $105k first rental purchase price). Bank financed the rest but I had to have a decent income to show as well. This was in '05, so the banks were much more lenient then, but was still difficult. Just have to keep pounding on banks doors until you get a yes. Don't give up!
