Yep looks like you have some tough tenants.  If you give notice to enter and they refuse you might still be able to enter but would definitely consult an attorney on that one.  With respect to eviction laws yes you could send notice on 15th and then efile or have attorney efile (start) eviction after 5 days, which would be on the 21st if they pay rent on 1st.  You have a few more days to go.  In the meantime you might find recommended eviction attorneys via BiggerPockets or you could reach out the the RI bar association and they would send you a list of attorneys that practice in that area.

Contact  the tenants, maybe they don’t know where to send the checks, maybe they paid last owner last months rent, maybe they told last owner to just take last months rent out of security deposit.  Lots of factors, don’t run to a lawyer just yet, see what they say first.  Then go from there.  Let us know what they say

meeting with an attorney is the best way to figure out what works for you, so many variables.

Look into umbrella insurance as well.

Could you hold the 40k as a note?  So he gets the house but maybe pays you back the 40k over 5 years?

@Kevin Manz, I lived in the unit and I didn't think anything of the noise until I went to a another property and couldn't hear the upstairs tenant at all.    So if it's possible to quiet the unit I would like to try.  It's not highest on my priority of things to do, but I would like to do it eventually.

@Sal H. we haven't gone ahead with anything yet.  In the future if we do I think we will pull out the old ceiling and put in new insulation AND put up the quiet rock.  Good luck!

@James Lanier Some lenders offer 203k loans, usually up to a certain amount like $30,000.  I believe centreville bank has one and you just have to put down 5% if you are living in the property.  Good luck!
