 @Jackie Cramer: I agree it's been a bit of a roller coaster. The problem tenants are moving out (lease ending) and I have already renewed the lease with another group which includes the 3 tenant ( good one)
thankfully the lease is ending.. eviction wouldn't have been possible in the current scenario. 

Too much drama. Evict them all, even the good one. Your lease likely needs review by a competent atty. and have him do the eviction, it's not in your area of expertise. 

Write off all costs as tuition in LL school. 

@Colleen F.: Thank you. That's a good tip. Until now I have only communicated with past tenants via text or email if I had to withhold any security deposit. I can imagine it would be a very problematic situation in case of less than ideal tenants (like the ones I have right now). I have requested the forwarding address (I am not sure if they are going to provide one)

@Kinnari Sanghavi  make sure you send a notice of the deductions from the security deposit well within the timeframe of MA law and have proof you did so.   You can even show a balance owed if that is the case.  If you don't do this, it is the most significant way you can go wrong.  If they don't give a forwarding address in RI and most other states you just mail it to the rental and keep the unopened letter.

If you are in MASS you have some real issue going on. First there is moratorium on any evictions so if they do not leave and don't pay, you are stuck for the time being.

Why is the tenancy ending on the 12th? It should be first to first. 

If they do move you have 30 days to return the deposit and/or deduct damages, including unpaid rent. Do not give it to them before they move out.

Do they have another place to go? I find it unlikely that anyone is moving at this time.

I love how they want their security deposit back to pay other bills when they owe for past rent. Hahaha

@Theresa Harris: the new lease is already in place with third tenant. 

I'm confused as you said the third one is renewing the lease, but all three signed as a group and two are moving out.  Is the one who is staying taking over the lease on her own?  If so end the one lease and start a new one with her-deposit included.

 @Lien Vuong: thank you for your response. I have never had to deal with something like this in the past. Do I  have to get the certified letter from someone in particular? Do I mail them the letter? Like I said they are not responding and COVID is making it incredibly hard to get out and meet them face to face

The third tenant is really great and is paying as agreed upon. I don't want to drag her in this. She has also renewed the lease. 

You can report it to a collection agency but first send them a certified letter stating that this is a formal request and if they do not comply you will have a debt collection agency go after it and it will effect their credit and lending opportunities in the future - you will have to do it for all 3 because they're responsible for it collectively. These tenants needs to be taught a lesson. 

 @Theresa Harris: unfortunately I signed them as a group. I will definitely be mindful of that in future. They are in the process of moving out(lease ends on 12th). They expect me refund the majority of deposit to pay the other bills they have accumulated. The security covers $2050 of $3130 owed and obviously will leave me with no buffer to cover the necessary repairs if any needed. They are unresponsive to calls, text etc. The lady tenant is so foul mouthed and I am so not equipped to deal with people like that. I would like to know if there is a way to hold them accountable for the outstanding amount after they have moved out?


@Kinnari Sanghavi  Tell them that while they are living there, they must pay rent.  If they can't, then give them the one time option to leave and break the lease.  I'm assuming you are renting to them as three separate individuals, and not a group of three (ie 3 leases, not 1 lease).  Tell them that they security deposit is only to be used at move out and not during the lease to cover unpaid rent (make it clear as you can take the unpaid rent out of the deposit at the end, but don't want to rely on that for the reasons you mentioned already).

I would not renew the lease to the two problematic tenants.  Get them out as soon as you can.

@Lien Vuong I absolutely plan on doing that. The hilarious thing is they expect me to refund the deposit so they can pay other bills they have accumulated. And then "intend " to pay me the back the owed rent couple hundred $$ every month after they move out next week
My question is the security will cover $2050 of $3130 owed, how to I work on collecting the remaining portion?
What if there are damages and they need to be paid for?

@stephen J Davis the are in the process of moving out. Lease is ending on 12th. It is my fault that I constantly bought into their son stories and was trying my hardest to help them through the difficult situation. I Will most definitely be prompt in future to take necessary actions. Being a landlord in Massachusetts is a challenge in itself. Thank you for your response

Hello BP family

To cut the long story short I rented my condo to 3 individuals, 2 of 3 were less than ideal candidates with poor credit score (bad idea!!) Etc

The 2 tenants were late on rent almost constantly. Coming to the point the lease is coming to end next week and they have outstanding balance of over $3k including late fees (I know should have given the eviction notice the first month itself.. lesson learned)

They expect me to just withheld $500 from security deposit, so they can pay other bills and they will continue paying a small amount every month (so they say).  I don't trust them, they are incredibly rude, irresponsible and feel entitled

 I am really worried about them damaging the property and with everything happening it's nerve wracking. I plan on doing a video walkthrough with the 3rd tenant who is very responsible and has renewed the lease. My question is how do I hold them accountable for all the money they owe in back rent and damages if any, once they move out. Do I just keep the entire $2050 and cut my losses ( Massachusetts landlord here!)

They don't respond to calls, texts and don't care about communicating
