@John Franklin I have to agree with you. Although I don't regret getting my license, I definitely do agree that it just complicates things. I'm going to read through the entire TRELA to get a much better understanding. Thank you John.

Thank you so much for the encouraging words! Honestly I'm not sure if the offers I'd present would look fair to others since the properties I'm looking at involve financially distressed owners who do not have their properties listed. In my state (Texas) there are auctions for properties with delinquent taxes, which you can get for whatever is owed minimum (If no one bids against you). To me it's very fair for me to pay off peoples' delinquent taxes and give them cash on top, and even informing them that it isn't the only option. To others it might not seem fair. I'm thinking I could discuss with an attorney to get their opinion. Once again, thank you for helping me out Bevla!

Thank you for your input on this post, it's very insightful! I have a question and would appreciate it if you could help me out. I have my license but also want to invest. The "roadblock" I've hit is that I'm not sure how to do the deal since I'm licensed. 

I've heard we need to treat everyone fair, but what is considered fair? Is under market offer considered not fair, even if the owner is in distress? Questions like these confuse me and ultimately lead to my in action unfortunately. 

I was also recommend by another BiggerPockets member to get a lawyer to offer and do negotiations for me to protect me. This has gotten me to think I should maybe not continue with my license. I'd appreciate your thoughts, thank you!

Could I do the deal without brokerages involved, by just going to title? Or would I have to represent myself AND the seller find an agent? I might not be clearly asking my question, could I essentially opt out of representing myself? Do I need a lawyer to represent me? Thank you.

@John Franklin thank you for the heads up! I believe what you mentioned is what was tugging at my memory. To be clear:

-if I was to go with a lawyer to write up the contracts, does this mean that the transaction would be done without my brokerage?

-if they're negotiating for me, does this mean that I can not be part of any of the contact with the owner if it's regarding purchase price?

I'm not sure how much it would cost to go with a lawyer, but maybe it would be better to just not do business with my license?

@Jacob Sampson The thing is I'm not sure I know of a law that is regarding this, like you said. I only remember either reading somewhere or hearing from someone that since Realtors have a professional understanding regarding real estate and comps we need to give fair value offers? But then again, like you said, it seems to grey of an area for there to be a strict or definite law for. Thanks!

When making an offer on an off market property, as a licensed Realtor, do I have to give a fair offer? I understand I have to disclose my license. (IN TEXAS)
