Thanks Theresa for your response. Her deposit was 1month rent, which would go against January rent.  by the 15 th she would owe 15 days rent, plus fees and any property damages. I don’t expect I will get any of that back, any suggestions ?

Thanks Mitch for your response. The property is located in Dallas county TX. 

I am going through my first eviction, the tenant is late for Jan and Feb rent, off course she had excuses about her restaurant business that made me wait that long give her the notice to vacate, which I served to her on Feb 4th with 4 day to leave, gave her till the 8th of Feb to leave. But she told me she will not leave until the 15th of the month because she is looking for another place and 4 days is not enough time for her to move out. She has been living in the house for 1.5 years with no issues except the past few months being late for rent. I did a mistake of letting her not pay the late fees the past few times as act of kindness to her situations, which I think contributed to her taking advantage of it.

I am looking for advice, should I wait till after the 15th to file the eviction lawsuit, considering she had been a good tenant? or should I start it now?
