Update: The builder finally came around and is now okay with me attending virtually (after many calls and a nice email about my extreme situation to management). Thanks everyone for the replies!!

 Regarding the Final Orientation / Walkthrough, it's worded like it's a suggestion not a requirement. However, their Default and Termination clause has me worried:

“Notwithstanding the foregoing, Seller, in its sole discretion, without being in default, may terminate this Agreement by written notice to the Purchaser and the payment to the Purchaser of a sum equal to one percent (1%) of the Purchase Price of the Property. Upon the tender of said payment, whether accepted or not, neither party shall have any liability to the other.

Upon either party giving a written notice of termination as provided herein, the Seller shall be entitled to offer for sale and sell the Property to any other person unfettered by any claim of the Purchaser. The parties specifically agree that after any notice of termination is given by either party to the other any claims shall be limited solely to the payment of the sums provided herein and no other claim shall be asserted against the either party or the Property.”

Here’s an idea… tell them you’re sending a licensed inspector for the final walkthrough since the inspector will know more about the construction standards.


 I already told them I am sending an inspector.

A POA wouldn't be labeled "fraud", right? From all the responses, I think the safest thing to do is to use a POA for my agent to legally represent me.

I understand their rationale for requiring an in person walkthough.  However, it would be interesting if they actually backed out of deal because of it.  Besides, it sounds like it a company policy and not in the contract.  Just assign somebody else with Power of Attorney or something...  That should get them off your back...


 Since they’ve priced the same model $60K higher since contract signed, I feel like they might want a reason to cancel and re-list at a higher price. Even if it’s 7 days before closing.

The sales contacts keep responding that management says no because it’s against company policy. Even after my agent emailed them this:
“So, since I will be in attendance in person, for the final orientation can we please allow Kevin to attend virtually? Unfortunately, his schedule makes it almost impossible for him to attend in person before closing.
If you are not willing to do a video conference for the call, I am willing to get him on Facetime myself if you’d like.
We would appreciate it if you could please check with management to allow us to do this. I can understand if nobody would be there in person but since I will be there and am Kevin’s representative, I would hope that would be sufficient. Thanks so much!”

I bought 2 new construction homes during COVID with M/I Homes and was able to do both pre-drywall and final orientation virtually while my agent attended in person.

Now, I’m investing out-of-state again with Mungo Homes but they are trying to force me to physically present for final orientation. When I called, they said management had changed their company policy and there are no exceptions.

“The final orientation is a meeting you will need to be in attendance for in person. Management is not allowing us to let people attend these virtually anymore.”


What would happen if I didn’t show up? Would I still be able to close?
