Post: Tenant Lawn Care Responsibility

Hi everyone!

We recently had our tenants give us 30 day notice (August 31 is move-out day).

The tenants are responsible for mowing the grass and have not done so since giving us their notice. Today, we noticed they moved a lot of their belongings to their new home which included the lawn mower & weed whacker.

The grass/weeds are decently high and they clearly have no intention of doing any yard maintenance for the remainder of their lease.

My question is, how do we go about it when we confront them about it and they *inevitably* refuse to mow the grass? The lease states that we (the landlord) are able to charge the tenant for snow removal, but it does not give a specific number for lawn care.

Are we able to charge them for our time, or hire a lawn care service and deduct that from their security deposit and outline it in the disposition letter?

@Scott M. the way he worded it was odd,  she is both saying she doesn't need to give 60 days (and is only giving 30) and threatening legal action if we keep her security deposit as that second months rent. She claims the law only requires tenants to give 30 days notice for a month to month lease and is completely ignoring that she signed a contract that holds her to a 60 day notice. We’ve sent her the part of the lease that states it and she continues to be combative and aggressive with her responses, claiming we are trying to “stiff arm” her. We've never had to deal with this situation and have been advised by the PM and other investors that she has no case, but since this is the first time we've had this situation we want to make sure we go about it correctly and hoping we can learn from this and be more confident in the future
