Wow! I had to read through some of my old posts from 12 years ago. I’m still in the RE investing game but with prices the way they are not anything like what we were shortly after 2008. We picked up the bulk of our properties via foreclosures after the 2008 debacle. I think we bought 1-2 a year for a few years and then nothing until 2017 - 2019 when we picked up 3 properties right before the market (and Covid) went crazy! I’m glad we did because those same houses wouldn’t be affordable to us at todays prices. 

One of the places we bought after the market skyrocketed we found in early 2021 on Facebook Marketplace by owner and I just know had the seller put it with a realtor it would of been way out of our range. So that felt like a little miracle :)

I hope you all are still doing amazing things! I’m laying low in this market and not buying as the numbers just don’t work on anything I’ve come across.

Does anyone know if this passed or when it takes effect? I’ve searched but can’t find any info on it other than the original article of how they were considering it.

QUICK UPDATE: Went to court and got the judgement for eviction. Tenant showed up to court. She gained a bit of sympathy from the judge and he gave the tenant until Feb, 5th before we could get the sheriff. Tenant moved out the day before and gave us the keys on the 5th. Fortunately, the house isn't trashed although there is a hole in the wall that will need repair and general cleaning and cleaning the carpets.

It is a relief though that it all went as smoothly as it did. Although it would of been nice to avoid going through the eviction process.

Thanks for the feedback. I guess we'll have to wait and see but sounds like no more than 10 days if we are awarded the judgment. Which I can't imagine us not being awarded it. I'm hoping the tenant gets the hearing notice and realizes how soon it is coming up and just moves prior to then.

Well, we are having to go through our first eviction process. Tenant didn't pay (she's on a lease) and also hasn't paid the water bill so we'll get stuck with that I'm sure. She says she doesn't have the money for rent or water. Gave her a 3 day pay or quit. She said she has no place to go and is staying there and told us to "Do what you have to do". The kicker is this gal used to be a landlord herself at one point so she knows the process.

So we filed with the courts and have a court date coming up. Likely this tenant won't show up in court. So if we win by default, how long does it take from the time we get the judgment to have her officially evicted to the time when the sheriff will go out and remove her? My understanding is we take the judgement documents downstairs to another office in the courthouse and schedule with the sheriff to go out and remove her, but I'm just curious based on other's experience how long it takes to actually get a sheriff to go out to the house and have a tenant removed? Are we talking days...weeks or ??

I've heard they ask them to leave the premises immediately. If they have stuff in the house what happens to all that? Do we just put it out by the curb and it's the tenant's responsiblity to come and get it?

We have four - 2 bedrooms and two - 3 bedrooms. We've had much more success in renting and keeping tenants in our two bedroom houses. They also rent quickly. One of the 3-bedrooms we've had 2 tenants so far over the past 2.5 years. The first tenant broke the lease, we sued, won and received full payment for what was owed plus attorney fee paid. The second tenant in that same 3 bedroom we are in the process of evicting for non-payment of rent. She's also been late several times but finally did not pay at all. Gave her a 3 day pay or quit and she's still sitting there so we have to file with the court (uhhg!) in order to get her out. So she'll sit there I'm sure until she's forced to leave.

So the point is, we've definitely had better luck with our 2 bedroom houses. Most tenants in our 2 bedrooms are either a single Mother with 1 child (a teenager) or a couple in their 50's with no children. So we've been pretty lucky with the 2 bedrooms and I wouldn't hesitate to buy them.

Update: Got word this morning that the bank accepted our offer! So I'm pretty happy right now. It sounds like they are also open to closing at any time, so that is also great!

You misunderstood what I was trying to say. What I meant was those here on the board that feel it's ok to lie/bluff and not be 100% truthful, I would think they too would do their deals like that and therefore I'd hesitate to do business with them. I get that RE agents may do these things but at least there are channels of the process. When you are dealing with someone outside of the profession that say is just an investor or looking to borrow money I would hesitate as I'm not sure I'd feel comfortable if they feel it's OK for others to practice busy by lying or bluffing to get what they want as they would do the same to me. That's all.

It may be the way the game is played but I will play on my terms and if it costs me losing out on a house, so be it. There will be more. So far we have 5 houses we've purchased so I can't complain about that.

My purpose for this thread was simply to ask how often it happens and if others experienced it as well, not to get into a debate of right and wrong. I get it after reading the replies that this kind of thing is common so that is what I wanted to know and will go into future offers with that knowledge, not that it will do any good granted.

Those folks that accept and even encourage RE to do whatever they have to do to get the highest offer, including lie (bluff, whatever you want to call it), that's up to them. I will say though that knowing they give the green light for that type of business practice would make me think twice about doing business with them as well. Because there is no doubt if they encourage or approve of others bluffing, lying, etc., they themselves will do the same exact thing. It's just not the way I operate. So hopefully, we can agree to disagree.
