Post: Federal Lien Removal process

I plan to bid on a property in a NJ (judicial sale) sheriff's auction that has a Federal Lien attached for IRS 1040 taxes.  This lien is junior to the foreclosing mortgagor, and will be wiped out.  The Government was correctly notified as a party in the original foreclosure complaint.

I understand there is a 120 redemption period for the Feds from the sale date.  I have scoured the 'net and not found anything (even on IRS site) as to the process for getting a formal Discharge of the Lien from the feds after the redemption period.

There has to be some way to Discharge that could be Recorded; otherwise, during a title search the Fed Lien would still show up and prevent me from selling the house.

Has anyone done this before who could opine on the details?

Thanks Zulma - I have municipal charges covered.

In fact, I figured out the difference in the mortgage note vs. the final judgement - all interest.  The note was accruing at 7.25% for 7 years + tax and legal expenses.

All,

I'm planning on bidding on a property at Sheriff's sale in September that has the following liens:

$540,000 senior mortgage

$21,000 unpaid municipal taxes.  There were several other tax sale liens, second mortgages, and a federal lien, and all were paid off/discharged.  

However, the judgement/upset amount published in the sheriff's website is $853,000, and the judgement posted in the newspaper is higher at $990,000 - significantly higher than the open obligations I found.

I've done a thorough job about checking the title at the county clerk's and statewide judgment database.

What could I be missing here?  I'm worried that I'll be stuck with some other lien.  I know this guy had been in federal court years ago, and had significant fines to pay.

Is there a Federal lien system I can check?

I'm assuming I should be able to find all liens that total close to the upset/judgement amount.

Any help is appreciated!

Hi Everyone,

I'm planning to attend a Sheriff's sale in NJ in September, and have selected four candidate properties.  I've seen the properties and run title searches, and understand the open municipal obligations (tax, sewer etc), lien priority etc.

My friend who is a professional title researcher mentioned that in addition to the county clerk's data I should also be checking Upper Court Judgements.  

I subsequently found the NJ online Judgement search tool for "Statewide" judgment liens filed in NJ"

Question: so there could be judgements attaching to the property that are not recorded at the county clerk's as a lien?

At the Federal level I've seen liens recorded at the county level on properties, and could there be other Federal liens that aren't discoverable by either the county clerks or NJ judgement database - and how would I discover those?
