Unfortunately we have accepted rent from the tenant. She deposits it directly into the bank.  

Any suggestions on how to stop accepting rent if she is depositing directly into the bank (or how to return it)?

We have a tenant who does not want to leave. The lease is month to month and we gave her notice 60 days ago!  

She is trying to find every excuse to stay in the property and on Sunday she emailed us a CDC declaration (she has not lost her income due to covid, has a job, social security disability and she is part owner of another property). We do not want to renew the lease, since the house is in very, very poor condition and she is usually late with payments and the rent is way low compared to others around. We are worried about the house since it needs desperate repairs.

We tried offering cash to leave but this did not work. We think she does not want to move because of the hassle since she has quite a lot of stuff.

Can we evict the tenant? how long will that usually take?  the tenant will try to find any excuse to delay or stay at the house. We are not evicting her for lack of payments but because the lease expired and we want our property back. 

Is this affected by the moratorium that is in place right now? 

Any guidance will be appreciated. Thank you!

This is for a property located in east point, GA.

We have a tenant that made partial deposit of cash into our bank account on the 5th of the month. (rent is due on the 1st).

We already gave the tenant 60 days notice since we need the house back and the lease is month to month.

What is the best way to proceed here?  We do not want the partial payment but the money was deposited directly into the account.  Is it possible to send the money back to the tenant (we will be sending the money back on the 12th)? 

If we wait until next month, how can we deal/prevent with this situation?

Luckily, Georgia is a pretty landlord-friendly state.  Each county and court system has it's little quirks here. Covid has made it a little more complicated as some counties are not serving eviction notices at the moment.  Normally, it is not terribly complicated.  Give them 60-day notice once you have closed on the property.  If they don't vacate, file a holdover.  Usually, to get through that process, you are looking at 3-6 weeks.  We manage about 600 doors and usually what happens for us is the tenant vacates a week or 2 after being served by the Marshall because they realize they don't have much hope if they try to take it to court.

Could we say the total time (worse case) scenario for an eviction is 14 weeks? 

This particular tenant seems to be trying to stall everything as long as possible. The tenant has already cancelled the house inspection 2 times and usually waits until the day prior to the appointment to cancel, so I am expecting the tenant will try to slow things down and stay at the house for as long as possible.

We are still in the due diligence period (we have a few more days) so I want to make sure I cover everything before the due diligence expires.

It is a little scary since this is our first house but we are trying to inform ourselves as much as we can.

Hello, we are about to close on our first property. The owner does not want to deal with the tenant so we got a better price but must close with the tenant in place. The tenant is month to month at this point.

I was wondering if someone has done anything like this before and can provide any insights on what to do / expect.  

Also, we understand that we can give the tenant 60 day notice after closing but beyond that we are not so sure how the process works, specially if the tenant refuses to leave.
