Hello,

Tenants for 2.5 yrs and I recently sent the Tenants our agreement to sign but they never returned it. I've had to give several notices to fix or move and they didnt do either. I also just found out my Tenant lied on his application and was supposed to register as a sex offender YEARS AGO!!. When I looked at his record before signing it was clean. There are 4 kids living next door and he lives with a child. 

In Oregon its very hard to evict. This is my question if anyone knows;

I now have a family member wanting the place and I gave them the required 90 day notice to move. Tenants claim they are not moving.
I will now have to evict. I do not have a signed agreement with them because they never returned it...Does it fall back on the prior written agreement? I had made changes and updated the most recent agreement, rent increase. TIA

Thank you to all the great responses.

A quick history. 

This current unit, had an extreme chain smoker tenant plus her 3 friends that were always there..at time we purchase it. When she moved out, we HAD TO remove all the drywall because the damage was so bad. I can still smell it.

I explained this to the current tenants and of course acted shocked and stated they hated smoking. 

**Yes, I know people lie to get in.**

My Father was a Fireman, I know all to well about this issue and people dying in fires caused by smoking.

My question was more related to the liability of the damage to property or others property, then the hiding it and I shouldve made that clear in the OP.   I also have a sue happy neighbor that Im currently dealing with regarding the fence, she mentioned them smoking and said,"I've seen them smoke behind my property and I hope they dont burn my place down." 

Which lead to the posting of my question.

Ive noticed in my area a lot of the landlords are asking for Liability Insurance, I guess I should have too.

 They signed a Lease stating the unit is a non smoking unit including the premises. Of course they were in the street, when I walked around the corner and saw them. I agree... they will smoke inside too.

Of course they will not be responsible. It would be an accident caused by smoking that you knowingly condoned.

 Well... I caught them smoking in the street not on the property. Nonetheless, they"re smoking.

Hello, 

I recently found out both my tenants smoke and they lied about it. I had them sign a Lease and in that lease they agreed to the no smoking rule. 

So, I am choosing to pick my battle here but they now want to move into our front duplex that we are remodeling to all brand new. I, of course will have the same rule but knowing they smoke, I am reluctant to have them rent it. 

My question is this: if something awful were to happen, like a fire, what, who, when would happen?

Would they be responsible for the damages? Thanks
