Love this site.  You guys make me think of this quite differently and I I appreciate the support. 

I decided to just call and see what I could work out. Turns out (after just letting her rant) I got 4 hours this Sat. to show it.  She will not be there at that time.  I have 4 possible renters lined up, too.  

On the prior phone call I did remind her and her soon to be divorced husband that their actions would make them liable for damages and lawyer costs.  I think letting her have time to digest and save face helped me get her to open the door.

It does surprise me how people interpret things.  The almost x-husband got upset and refused to believe it when I told him he was still on the lease regardless if he left 6 months ago!! 

Anyway, I learned that vetting tenants and that having to low of a price point attracts the wrong people.

Yes, I am worried about the tenant's reactions if I show it without their consent. 

I know they will leave because I raised the rent to make her leave (gave her the option to leave).  She gave me a 30 day notice.  I am just tired of her being so disagreeable. 

The place is presentable and I will have a flash clean up crew come in when they leave. 

The thing is, I don't want to loose a month's rent and even though by law her actions will make her liable for damages (lost rent) and lawyer fees.  Who wants to go there, though?

I really think I don't need consent, but am not sure.  Being unsure, I can see trouble.  In fact, I may have to show the place several more times in the future .

My tenant is mad at me and gave me their 30 day notice.  Being that I now have prospective tenants wanting to see the house, I texted notice that I would need to show the place and gave an option of either this Tues, Wed, or Thursday.  The current tenant refuses and states I can only do it on Sat.  That doesn't work for me since one of the prospective tenants will be driving 3 hours to see the house.  The current tenant is very aggressive, she yells, and makes wild threats looking for a lawsuit. 

I have a lawyer, but he is not up on KY Landlord / Tenant law.

Can I give notice and enter regardless of what the tenant says?  She would be at work and no one should be home.

Here is the KY Statuate:

383.615 Access.

(1) A tenant shall not unreasonably withhold consent to the landlord to enter into the dwelling unit in order to inspect the premises, make necessary or agreed repairs, decorations, alterations, or improvements, supply necessary or agreed services, or exhibit the dwelling unit to prospective or actual purchasers, mortgagees, tenants, workmen, or contractors.

(2) A landlord may enter the dwelling unit without consent of the tenant in case of emergency.

(3) A landlord shall not abuse the right of access or use it to harass the tenant. Except in case of emergency or unless it is impracticable to do so, the landlord shall give the tenant at least two (2) days' notice of his intent to enter and may enter only at reasonable times.

(4) A landlord has no other right of access except:

(a) Pursuant to court order;

(b) As permitted by KRS 383.665 and 383.670(2); or

(c) Unless the tenant has abandoned or surrendered the premises.

Hey thanks, guys.  Yeah, there is lots of learning to be done and things to get going.  I am taking the first steps and told myself to start taking action and getting things done.  For me, I have read enough and have the right mindset.  Right now I am checking out brokers and schools.  

As for the schools, I have 96 hours of class to do so I need to plan for 60 - 90 days of regimented evening studying .  There also is a 2 week blast course in town by mentioned A Pass Weikel.  

I went to a Keller Williams's info session.  I liked what they said and half way through realized they totally used the same principles as heard on BiggerPockets and built mentoring, lead generation, operations, and support systems into the business teams they build within the franchise.

I also have plenty of other things to do.  I need get my finances in order and physically make a plan with goals, dates, inputs, and outputs.   I need to build in time for the preparation and finish up some other projects ( like the almost done head gasket replacement I started before it got cold.)

I look forward to using BP and meeting it's people in the days to come.

I am heavily investigating a career in real estate as an agent and house flipper. My goal is to obtain the KY state real estate license by May?, 2016, change jobs to 'Real Estate Agent' this summer, and flip a house this year.

Currently I own 1 rental and my own house - both I rehabbed with my own sweat and tears (plan to be less hands-on in future with this under my belt). After a few weeks of reading / listening to Bigger Pockets I realize I need to re-evaluate my position on the rental home. I can say I have rented my own home for 3 days during Kentucky Derby for over $4000 for the last few years and plan on continuing that practice.

I plan to ask for advice on my first couple of flips and connect with local members. I have listened to the first 40 podcasts and sincerely enjoy the education and conversation. What a resource for us new guys.
