Thanks for the advice. What you outlined was course I was planning on taking but being new I guess I needed a little reassurance. My only concern was with stuff left in the unit but already took pictures and I have video from previous days when I entered unit for maintenance. So there is evidence that unit has been in same condition before and after the notice.

Hello everyone, I have a situation not sure how to handle because I'm new to landlording business. I purchased a quad to house-hack a tenant moved out the week I closed on the property and I had a hard time contacting them. I posted notices to go and do repairs and maintenance of of AC everything is gone all that is left is an old tv some shoes boxes with trash, light was cut. I finally was able to talk to husband and he stated they needed more time I did notify them that they were still responsible for October rent as their lease ends October 31. They have not paid so tomorrow Ian placing notice to pay or quit and by Texas law tenants have 3 days to either pay or vacate premises which gives them until midnight of the 6th. So on the 7th do I need to file eviction or can I just take possession of property since they have technically vacated??
