First off, thank you for your inputs! 

No, I don't want to do anything illegal, but this isn't exactly the normal way to go about making a deal now is it? What do I say, " Hey! Found out a dead guy lived here for a while and now I know your kid is his only heir so, whadda you say? Let's make a deal!"

 Well I have found the person, and I am going to go visit them sometime this week or next. I would like to know how to get the heirs to open probate and then sell it to me before it gets to the right of redemption stage.

In my searching for property I was in florida once and found an extra bathroom that was enclosed and covered to make look like there was no bathroom, the layout of the house looked off, there was lack of space where there should be space, I drilled a hole in the wall to see and low and behold a complete bathroom with toilet, sink and bathtub/shower. I was happy with the find but my spouse freaked out and was convinced someone had left God only knows what (drugs, a corpse) in there. We didn't go back.

I want to be a PR for a property I found. No one stepped up to claim body, no one stepped up to claim house, no one stepped up to do probate. I want this house and am willing to risk it. How can I get a Death Certificate in Maryland as an "individual who has a proven legal need" if I need the death certificate to get proof of legal need. Because I can't be a PR without the death certificate. He died a year ago in his house, mail man smelled it, called cops, morgue pick up body, probably, body used for science, no funeral. What if I lie and say I am a distant cousin? I'm not claiming to be first heir in line, just family to open estate. I know it is shady, but I will make sure that anyone who has skin in the game gets their fair share, I just want to buy it from someone, but the lien holder paid way to much.

Hi I am new at this, first off I didn't really know what category to put this in... Thanks in advanced to reading and your input, used or not, it is truly appreciated! 

I have opened a discussion about certain details of this deal before but thinking about paths to go and wanted some advice. 

Here's the deal: I find a property in tax sale, got sold in tax sale to lien holder, owner is dead, no heirs have shown up. I dig and dig around and find heirs, a brother and a minor. Rotting flesh is still there about a year after he died. Morgue came, took him after 2 weeks according to police report, no one claimed body. Only now is brother claiming house. The brother doesn't want to open up probate and doesn't tell me about the child (his nephew) , tries to sell it to me, but can't because it would have to go through probate. His attorney suggested that they might buy it from the Lien Holder. The property is not worth what the lien holder bid on it (about $200K) and would still need to go through probate because you can't serve a dead guy. 

Now I am trying to contact minor's mom to give her the news that deadbeat dad (dna test, court order, child support) has a house that I want to buy. Found some old numbers and spoke to some family member using google translate and got hung up on in another language.  I found her address, I know where she lives, I know how much she owes on her property, I know how old her child is (15). I can't find her number.

Say that I go to her place, wait around until she comes by (not creepy at all :P) and then tell her, you know that guy that your sons dad? well he died and I want to pay for you for the house, legal fees and all. Or send her a letter a long the same lines. I have 2 options here: she will either say, "Yes! You don't sound crazy at all!" or say, "No" and get a court order for me to keep my distance. 

Is there an option for me to file probate and then go talk to her? I can be the PR and deal with her and the brother at a better standing position. I understand that there might be debt and a chance I will get burned but getting turned down without the opportunity to try is bugging the sh!t out of me. Did I mention the property is already sold at tax sale? I only have like 3 months before they have the right to start foreclosure proceedings.

So I don't have the money to buy it from the Tax Lien Holder, which is about $200K that they bid on it, plus I still would have to open probate because it is in a dead guys name (according to what I've read, please correct me if this isn't true). I do have enough to pay the taxes off, liens, funeral, etc and attorney fees and give her something, if her son is the only heir which according to my research it is just him and the brother, but in the line of heirs the son has the most to gain. The brother doesn't want to deal with the baby mamma, he was told by the attorney that he should just buy it from the tax lien holder, the child, being a minor has been proven to be the child with DNA testing while guy was alive. 

I tried to call her, but I only got one number related to her (the grandparents of the heir). Who spoke no English. Tried to call them again and use google to ask the number and I might have insulted them with my over-abundance of ignorance... I still have her address, I know she lives there. 

The Sibling seems to have enough money and was thinking about getting it, but it is expensive and he is old and in FL, he has a business (something in foreign trade according to his lawyer) and upon talking with him, he seemed like he doesn't know anything about real estate investing.

Every month that passes cost more in interest and I don't want to pay it if I am going to do this deal. At least I want to try and talk to her to see what her thoughts are. But what can I say to make her understand that this is a real deal I want and I'm not just a scam? I want to go to where she lives  and talk to her face to face but there is a possibility that I will scare her. Also I was worried that if I send a letter she will think it is spam and throw it away without understanding.

Hi, I have found a property that was sold in a tax sale, in the state of MD, not in B-More City, found out that the person died in the house, also the only family member that knows is someone in FL. 

THat family member has not opened probate, upon further investigation. I found out that the dead guy has a child out of wedlock where they went to court for Alimony, a few years back. Found out the child is a Minor. I have found the Mother but I have not called because I'm not sure what role is of benefit to me in order to get the house. The guys sibling might want it but he doesn't want to pay the back taxes, I spoke with him directly and he is thinking of buying the tax lien from the Investor who bought it during the tax sale. It is too much for my pockets (after all this site says, "Bigger Pockets", not: "ALREADY HUGE Pockets"). Well I think I can convince the Mom to sell me the house at rock bottom price as long as I foot the bill for legal fees and any debts. I've done my due diligence,  on all aspects, medical, financial, liens, etc. It works out for me. Any money in the bank that he has will be hers. As I said all I want is the house. 

Am I wrong to look at this as a win-win situation for her and for me? I mean this dead-beat dad never gave anything to her, and his family doesn't seem any better. I want to offer to pay all the legal fees associated, any liens and give her a certain amount (around $20K) yes I know that is pittens but I have to pay off the liens, legal fees to start probate, not to mention the costs of repair, and I don't keep or want to keep any of the actual $$ in any bank accounts or stocks he may have. It calculates to a good amount I have to spend, but still a good price for a house. She gets money she didn't even know existed and if she doesn't do it with me, well that's my worry. Do you think she will get greedy with the newfound info? I know she has a loan for a condo she got back in 2015, it would help out with that... Fear that she will hang up on me and lose $$ due to my lack of wording makes me paralyzed to act! :| 

If any of you have done this, enlighten me oh great ones! 

If you haven't, still any advice would be good... What do I say to her? What contract should I do to get the house bequeath to me before paying legal fees? What contract should I have with her? Should I offer to be PR? Is that even a possibility? Does she get to sell the house that the heir is her minor aged child?

First off, thank you all for taking the time to help a newbie out. I have done couple of deals and all have been with a real estate attorney. This one is a little different. I would be purchasing a Quit Claim Deed (QCD) and all the attorneys seem to be more interested in getting my deal or telling me it's a scam then trying to tell me how to go about purchasing it.  BTW I have already done a title search and have found some liens that I am willing to pay off, plus pay them something for the QCD

Here's what I understand so that I don't get the same response as the attorneys: 

* I understand that I am buying whatever rights (if any) the person who is selling it to me may or may not have. 

* I understand that if there are any outstanding liens, I am responsible

* I understand that the QCD is the least protected of them all

Here are my questions:

* How do I go from buying a Quit Claim Deed to getting any sort of Title on it with my name on it? Be it special Warranty or Guaranteed or as long as it's not a  QCD? 

* How do I do a settlement? (If there is a place that already tells me the steps, please give me the link) I will happily do the leg work in order to avoid fees. If you could explain the order, that would be great too! IE 1.. Do Title Search, Get Insurance 2.. Go to the county to record deed 3. Pay fees (since I don't know I'm just showing how I'd like to get the info, sorry to be so direct, but I'm really frustrated with the none-information I am getting from attorneys and settlement people). 

* Do I need a HUD-1 Form? Is it hard to fill out?
