Thanks Tom for the info. Will a cash out finance prevent me from having to deed over my side of the duplex?

I currently own half of a duplex and I currently receive about $1000 a month for rent on the unit. The owner of the other half is an investor and is looking to sell. The dilemma is the hard money lender is only willing to finance the deal if I deed my side of the property over as part of the deal. I really do not want to deed my side because I own it free and clear. What is my best course of action to take?

Thanks Tom, The realtor who sold the home before it was auctioned off lives on my street so I will ask her about the form.

Thank you. I thought in the state of Texas a Warranty Transfer form can be done within 30 days of purchase

I am trying to close on a home that has foundation issues. You can tell the home was repair but now there is issues again. The home was bought at an auction. I called the foundation company and they stated it was a life time warranty on the home but the owner has to transfer the warranty. Is there a process to get the  warranty transferred since the home was auctioned off? The old owner abandoned the home.

I'm trying to find a good attorney to transfer a Deed to my name I have POA over the property and need help to secure this home so I refinance in 6 months or so.

Gualter, unfortunately I do not have a deed only a sign contract from the owner who walked away. Which deed do I need to get?  How to have one written up. Do you have some advise?

The owner of a property has given me complete control over the property. They completely walked away. I have been able to pay the mortgage for 2 years not and also completed modification as the power of atty of real estate, or in the bank terms  "Attorney in Fact."   Now I would like to get my name on the tile  or deed so later I can refinance in my name only. How would I go about doing this? What is a good title company? or Attorney to assistment with a SWD?

I wanted to go through CitiBank since they have already pre- approved me and also has a program that waives all appraisal fees and etc fees, with my FHA loan personal home . 2nd NFCU will refinance my investment duplex.But I really need to get the equity money out of the property to help with my downpayment The equity should be 25,000 to 31,000 in Texas. What is the best way to pull this cash out so i can use some form my first lived in home and my second duplex 3rd I'm scheduled to look at the adjourning duplex in which has a tenant there. Any suggestion would be appreciated. I going through a hard money lender
