We just purchased a home in Austell GA and the seller posted on the MLS as well as many other reputable websites that the sewage system for the home was a public sewer for 2 months straight. Even now after we closed it still says public sewage system. With this in mind our realtor did not schedule a septic tank inspection during our due diligence period for the home since we were under the impression that it was a public sewage system. After we closed on the home we found from our neighbors that is a septic tank. We then found out that it wasn't working and the septic tank company that we contacted to come check it out happens to be the one the previous owner utilized. We found out that the septic tank needs to be replaced and will cost $10,000. When we reached out to the sellers agent. They said that the information posted on the MLS is as accurate as they can find and that they take no fault whatsoever. Then said that we should have had the inspector that we hired tell us that it was a septic tank. But how can they know if the MLS says that it's a public sewer? We have all the documentation from the septic tank company telling the previous owners that the septic tank was failing and the cost of repair. So, the seller was fully aware and still informed the realtor that it was a public sewage system. We sent a letter of intent to see if the sellers agent will compensate us for the new installation out of court but they are not cooperative. We will be reaching out to a lawyer soon, but does anyone have any advice or recommends a real estate lawyer in Cobb county GA? Thank you. I'm a first time home buyer.
