I agree, Nathan.  I'm a rule follower 110%.  That being said, I know some rules have loopholes.  I bought the house with the intent of renting it one day.  Then, life happened. I was extremely upside down, got married, had 2 special needs children, quit my job of 17 years and am a stay home dad as a result, trying to figure a way to make money.  Already if we rent we have no money saved for another home, we were really at this point hoping to rent to my Uncle  for the win win.  We'd likely move in with my father for a year to save up $ for a down payment.  Anyways, getting way off topic here, but, I agree...  I don't want to do anything that I may "get caught" doing.  Loopholes are what I'm after, the legal world is full of them :)

I appreciate the replies. I think I'll contact an attorney to figure it out. The HOA says only those who were actively renting when the rule changed are grandfathered in. John, I don't fully understand your post but since it got upvoted, I'll toss it to the attorney, LOL. I'll do my best to follow up with any information I do find.

I'm in FL and bought my house 15 years ago. It's time to move on and I'd love to rent it out to my Uncle. Unfortunately, my HOA ($100 a year style) says no new rentals until it reaches under a certain % of the homes. Very far off. This rule was not in effect when I bought but since I was living in it, I wasn't grandfathered in to allow me to rent it out. The issue I have, they don't enforce a multitude of other rules. Lawns are crazy high, trash everywhere, houses painted crazy colors. Could I raise the issue that they're being unfair in enforcing this rule to not let me rent when it's obvious they aren't enforcing other rules? I've sent them examples in the past that they would "look into." Never have. Should I being to take photos as proof? I'd really rather not sell the place, it's a perfect fit for my Uncle and he can't financially purchase a home. I'd rent it below market value and above my mortgage rate. Win Win. Damn HOA.

Any other way around this stupid HOA rule?  They told me I could incur a $1,000 per month fine if I was caught renting.
