I wanted to chime in here and note that I have been doing a TON of research in the last month on this subject for a client and personal interest.  I found what you found.  There are some single tenant A or B out there with 7+ CAP but they are (as has been pointed out) usually with very short terms left on initial lease or some other form of hair. Anything above a 7.5 and there is usually something really wrong. I have been triggered by a lot of market talk on Hotels though and wonder what anyone has seen with regard to 1031's and that asset class?

Hi Scott

In my experience potential buyers want leased space. Potential investors want empty space really cheap. I think what you want to do, if it is your plan, is fix up the space to lease it. Fixing it up would require bringing it to a usable, attractive, empty canvass as you say and leasing it out. The leasing process will involve more build out and updating to fit the tenant. You want long term tenants with great credit ratings who have NNN terms. The building itself needs to be workable to serve those tenants and equal replaceable tenants down the road. Once it is leased fully and costs nothing to maintain you have an property for a buyer.

To answer your specific question: Yes, I have seen this type of thing done.  It can be win win for both parties if it is structured right as the taxes are offset and private lending being easier, etc. BUT it is family and that can be tricky and can lead to issues.  Decisions to be made.  

Also, the structure of the Family LTD partnership is going to play a BIG role in how this gets done.  I agree with Bill that it could be done inside the business entity if it is strutted appropriately, but sometimes Family Partnerships are VERY complicated and again, this could be tricky.  The question to you is; is it worth the legal / accountant fees upfront that may lead to not?  is it worth the family entanglement questions? and if you stand to benefit from the outright sell, could that be a simpler transaction with a quicker yield?

Hello. My name is Jessica Wilson and I work in commercial real estate in Middletown, CT. I am also part of a large commercial property investment group out of California and in my personal life, with my boyfriend, work on REO single and multifamily purchase and resale. The commercial firm I work with out of California is primarily interested in 7.5 CAP and higher retail, medical or emerging market sale / lease backs, which is what brought me to this site.
