Jay is right, them suing you is a BIGGG long shot. But that being said, I can't believe that language in the sale agreement. In our sale agreement, earnest money is the ONLY damages that a seller can receive.  You need to find another agent or at least use a different sale agreement.

I've been a broker for over ten years, owned and trained agents. Two pieces of advice:

  1. Open houses. Do as many as you can. The new agents that became successful quickly took this advice. Join a brokerage with a ton of listings, and do 3-5 opens a week.
  2. Start investing right away. Don't become one of those agents that are 65 years old and still living or dying by their commission checks. Start buying rental properties, and build your portfolio. This is the best way to get rich with real estate.

Jay is correct, I've purchased homes at auction with IRS liens, they go away after 120 days, and I've never heard of one redeeming.
