You would have to have a STR and have a net loss unless you can qualify as a REP and again have a loss to offset active W-2 income. The entity structure is not relevant (except for additional LLC fees in California). I would dig into your situation more to see what can be done for tax planning and determine the best course of action.

We use RightCapital on an enterprise level and push it out to clients for tax/business/financial planning. It is terrific all around.

@Shawn Fletcher I'm not sure if you have a solo 401k plan that is with one of the larger custodians or if you have one that enables you to self-direct and has more robust features.  I have experience with what you are asking but it depends on the plan design and might require an amendment.  For example, the other day I had someone contact me that had a plan from a large custodian and they don't afford any loan provision and typically don't include other important features such as self-directing, Roth or After-Tax option, etc.

The need for liquidity/access to capital/income, risk tolerance, investment objective and time horizon will drive this decision.  Tax benefits too obviously.  The collective feedback you got from the other respondents is solid.  As I find myself saying... "it depends".  Everyone is different and you just need to evaluate the risks and rewards and be able to pivot as needed.

Look here - https://www.biggerpockets.com/blog/tax-partners and/or check out some of the tax professionals who are responding to posts.  Nearly everyone has remote capabilities as well so local is not necessary unless that is your personal preference.
