HUD is not a party to your lease agreement. The lease is a contract between landlord and tenant.

The lease in Massachusetts is from HUD. And it has a list of what the tenant and landlord is required to do.

So you're telling me, you have no valid lease with your tenant? You are not actually leasing your property to the person who lives there? I've got section 8 tenants in Massachusetts. Certainly seems strange to me that my tenants are who lease my property from me.

Did you not sign the HAP?

Hello everyone,

I am reaching out to connect with individuals who have experienced significant issues with the Section 8 housing program, specifically regarding their failure to enforce their own lease agreements.

As a landlord, I had a tenant under the Section 8 program who turned out to be a severe nuisance. This individual not only disrupted the peace of my other tenants but also engaged in criminal activities, including domestic violence and terrorizing children in the building. Despite multiple complaints and references to the lease section addressing criminal activity and nuisance behavior, Section 8 did nothing to resolve the issue. Instead, they told me it was my problem to handle.

This lack of accountability and support from Section 8 is unacceptable. The safety and well-being of our tenants should be a priority, and the program should adhere to its own policies.

If you have faced similar issues and believe that Section 8 has failed to uphold their lease agreements, I invite you to join me in a class action lawsuit. Together, we can demand better enforcement of their policies and ensure safer living conditions for everyone involved.

Sounds like a pretty normal Section 8 experience to me. This lawsuit has no legs.

True, worth the try. That you’re opinion

I'm no fan of Section 8.

In this scenario, I agree with them.  If I had the resident you describe, I would have filed for an emergency eviction and had that resident out of my property within days.  Why would you expect Section 8 to do this for you?

Maybe I didn’t provide enough, I am in court now going back and fourth since October 2023. Each time we get a continuation even with the police report the arrest record, so I reach out section 8 after reading the HAP lease I signed with them and the tenant and was told this is not their problem. It clearly states in the lease that criminal activity is not allowed, I expected at least for them to give him a warning but nothing. And for additional information so I don’t receive response like this one again. I have spend over $5000 so far trying to get him and climbing.
