Hi Matt, 

Thanks for the info, yes a notice to cure was sent but it will not be possible for to cure all the items for the various breaches (1 includes changing my hardwood flooring without permission) plus ,many unpaid bill and breaking local by-laws which have still not been resolved due to him missing court appointments for them. and not to mention unpaid rent. 

I have an attorney now who drafted the notice letter and I got him served. 

I suppose the next step is to wait for the 10 tens to be up.

Its just very difficult dealing with a person like this. 

Hi All, 

Yesterday I served my tenant for various lease breaches and unpaid rent since then he has been sending me messages every few hours, can I do something about this with the police? The last message I felt almost racial abused since he is questioning us based on our skin color??? 

For the record my wife is Canadian with a green card and I was born and raised in Chicago, IL. 

Not sure if I have enough to engage the police. 

1. See you in court

2. (picture of the notice he was served)

3. Glad he has my lies and dishonor in text messages

4. Do not contact Him or his realtor or his mother by text or email - all future communication should be through his corporate attorney and we should fix the dry wall problem in the swimming pool room bathroom and he will be reporting it to city of oak brook on monday for the record

4. if items are not repaired in 5 days he will fix them himself and send me a bill

5. he went on facebook got a picture of me and my wife at our engagement party from 12 years ago and calls me a dishonest liar and he and his attorney wants to know if we are US Citizens - I am guess this is from our skin color since there was nothing else in the photo to indicate anything "un-american" 

for point 4 i have reached out to the city of oak brook with details via email and hoping to hear back soon from them monday perhaps) obviously this guy is going to lie his heart out.

Hi All,

Should repairs be made by me the landlord after the first eviction notice is served?

The tenant is not paying rent since I will not extend the lease.

The repairs are minor things like sink disposal not working, shower drain plugged up (probably a draino job) etc. These were reported AFTER the tenant decides to stop paying the rent.

He keeps text messaging every few hours with different stuff since he was served today (I have ignored and will no longer respond) and now is trying to say he will fix the things himself and send us a bill.

My plan is to sell, if it doesn't sell I will empty and demolish the pool in order to get rid of the headache. I purchased the property to live but then moved since I wanted to move out to Seattle.

I was able to have him served by texting him into saying repair man was coming to fix an issue (something reported AFTER he stopped paying rent) - then my friend went and served him once he said he was home and waiting. 

Fooling him like this - would it be an issue in court? 

He has been evading answering the door to my realtor even though he was home - we could see him through the window the previous night...

thanks all, I have all documentation related and emails and texts from all the mold remeidation people I used. 

The strangest is he wont leave and also wants to BUY (at a very cheap amount) - the mold isnt a worry for him there.

Hello All, 


I had a tenant with notice to pay or quit.

Once he did that he texted us several times about he was going to sue us with mold issues.

Background Info:

1. We have an indoor pool (attached to the house but in a totally separate room)
2. There was surface mold in the attic only above the pool which was remediated and sealed in 2013 with a 10 year warranty - when we the owners purchased it and lived there.

3. Since then there were no mold issues since we looked after the pool and used ventilation and ensured no issues came up.

4. The tenant moves in in 2015.
5. Within a year there is surface mold in the bathroom (in the pool room) and we get this area remediated and sealed - we offer to release him from the lease on 2 occasions(once in Jan 2016 and also now) - but he refuses to leave

6. Now there is mold again (surface) (or so he claims) and now that he is been served with eviction for not paying the rent etc

7. He is threatening to sue me for mold that damaging his health but at the same time he will not leave!

We know for a fact he is trying to play this out as much as possible and get some money since we know its not in the main house and it was surface mold

Should I worry about this situation?

that will not work. The law here on this subject is very archaic. The court requires

either in person delivery or cert mail with a signed green card. The cert mail option

doesn't work too good in my experience because the Tenants rarely sign the green

card and then it is not effective.

Hello,

I am trying to service the landlords 10 day notice to quit the premises for breach of lease

The tenant will not answer the door or phone calls or anything so what is the best way to proceed to get the 10 ten notice to them?

The lights in the home are on but no one will come to the door.

I suspect he has been through this before.

What is the best thing to do here so I can start my 10 days.

I must have the document notarized once it has been served - saying it has been served.
