Post: Driveway extension with no permit

Last week we had a contractor add on a 10ft extension to our driveway. About a week later we received letter from city saying we did work without permit. Honestly we did not know we needed a permit for this, contractor didn't say a word about it. Well come to find out we need to cut back the concrete 3 feet from our property line to be up to code. Contractor said he will come cut it back but no mention of whether he is charging. The city told us this falls on him as he should of known better. Should we pay him to correct it if he does charge?
