One main problem in a case like this is because his wife is on the mortgage, he can not get additional monies to pay her off with without her permission (except for a complete payoff and refinance, like Jon suggested). And there is so much anamosity in these cases that one usually says "show me the money, then I'll sign". So you are usually stuck awaiting a judges order.

Best pass this one over until you have done a few deals.

This does not apply when you are considering the original question which is about tax sales/certificates.

If the deed/certificate performs, then you recieve the allowable interest. If the deed certificate does not perform then you recieve the right to forclose and recieve the property. There is no modification of this. It is encased in State law.

And with 50 different states (and one district) different rules apply. Plus within each state/district there are many, many, many different counties that are allowed to apply those state rules in different ways.

So you have about 5000 different sets of rules to learn.

Mike C. I like your statement. "When mortgage companies allow me to stop paying penalty free if I had a vacancy or a problem, MAYBE I will allow the tenant the same consideration."

Just try giving back your home (even in great condition) to the bank and only having to pay a two months mortgage payment after the 60 day notice.

Yep it is a contract!!!

Ask her how much money her title company has rebated to the banks when she had done the title insurance for short sales.

Title insurance is always added to the cost of the home sales, therefore the home was sold for more than the cost of the short sale itself, it actually included a profit for her title insurance company.

Did she defraud the bank allowing the short sale when her company made a profit on the title insurance?

I dont doubt there are many other similar stories. Inspectors reset their values about every 3-5 years, so I can see the current values going up to reflect the bubble values, even though the bubble has burst and values are currently lower.

Go figure, quick effective governemnt?!!!!!!!!

They do reset prices often, IF you oficially dispute the value. Most times I hear that this tactic wins more than it loses (if done properly).

You may be able to use this to your advantage. If you plan on purchasing it your self then flippling it, then put an subject 2 clause in the PA that you require an inspection by the codes enforcement inspector.

This will provide you with what must be done in order to comply. And they have to bring it up to code or agree to discount the purchase price by what that would cost!!!!

If just flipping it use the same subject 2 clause for the buyers benefit so he can back out if the problems are too severe.

I would be cautious about having any member of my "team" who could not pass a certification test. Contractor, Plumber, Electrician, ect. It is wise to have someone to fallback on to verify that all work was done properly IF there should be ANY future claims made.

FIRE ANTS

Here's a really sneaky way to get rid of fire ants. (All's fair in love and the war against insect pests.) The only way to get rid of an infestation is to assassinate the queen. Wait until a dry spell is about to end. Sprinkle instant grits on the fire ant hill. The workers will carry the grits to the queen for her royal meal. She'll eat the grits and when it rains, she'll drink. And that's what will kill her. The grits will expand in her stomach and she'll "bloat" to death. Once she's out of the way, the leaderless ants will die off. (This suggestion came courtesy of the Tightwad Gazette II book.)
