Post: Giving bonus comission to listing agent and seller

I am a Texas real estate agent, and with the crazy market, I want to make my offer more attractive.

I want to offer that my 3% comission be given to the listing agent and seller; 2% to listing agent, and 1% to seller.

How would I go about doing this?

Where in the contract would I put this?

Ok, and as far as the IRS lien, (from what I've looked into other BP forums and the answer above) would fall off after 120 days?

Thanks for your input!

And yes, from what the title company told me, there was an assumption of the loan by Trump, however the loan always stayed under Obama's name.

In this case, would the Federal Tax liens under Trump would still be considered an issue?

Thanks for replying! So, if I win the bid, and did a rehab, the irs would only covet the purchase price, or also whatever upgrades I did to the property as well?

There is a property I am interested in, and it will be auctioned at the courthouse next tuesday, so I order a title search.

It shows only 1 lien for $amount (I don’t know the current balance of the debt), originally taken out by Barack Obama and later the loan was assumed by Donald Trump when he bought the house from Obama. Since the bank wasn’t directly involved with the lien assumed by Trump, Obama is the one who still owes the bank

The title search is showing 3 Federal Tax Liens under the name of Donald Trump(No SSN or DOB)  it quotes

"We have searched and found the owner Donald Trump or similar names ( no DOB or SSN on file) for Abstract of Judgement or Bankruptcy" and then it procees to show the 3 Federal Tax Liens.

 Since we dont have the SSNor DOB of the Donald Trump involved, it is practically impossible to know if these liens are his or some other Donald Trump

My concern is; if I bid on this property and win it, what are the possible downsides or risks? Can the Feds take the property? Would I be able to take possesion to live or rent? Would Trump or Obama be an issue later on? 

Has anyone had a similar expetience?

Post: Cash Out Refinance Deal

Hi,

Just wanted to share my last transaction, in case it helps anyone.

I bought a house in one of the older parts of town for $77K with a Conventional loan that required 5% down payment, with a mo thly pmt of $760.

The house's AC unit didnt work and had to be replaced, and in general the property was very ugly inside out. I renovated the entire thing, floor, kitchen, bathrooms, all rooms, etc. The before and after is simply outstanding, the house looks old from the outside, but very modern inside.

So, just to put numbers out there:

$77K Purchase price

$23K Rehab (materials ,labor, other fees)

$100K Total Acquisition Cost

I then went to a local bank, because all other big banks didnt allow for a cash out before 6 months. So, the local bank agreed to work with me, and the property appraised for $125K, and they will give me 80% for the cashout. The closing costs for the refinance are approx $3K, and my monthly pmt only went up $6 dls!!

I'm closing this monday, and couldnt be happier, as I practically paid nothing to acquire a fully renovated property, still own 20% of it, and have cashflow.

Final numbers after cashout

$766 monthly payment (only went up $6)

$1,100 potential rent

$334 cashflow (not counting maintenance)

+ $100K 80% of appraised value which is 125k

- $3K closing cost

- $73K previous loan

= $24K cash going back to my bank

So, I could say this property cost me -$1,000 to acquire, making my ROI infinite! And still having 20% equity!

Post: Tenant Rights to breake a lease

Hi,

In this case, I am on the other side (tenant) not landlord, and I'm in quite a situation, I hope someone here can help.

I just rented a duplex in Arlington Texas, and since I moved in the fridge has not been working.

I have reached out to the property mgmt about 8 times, and they ignore me. I have all the texts and calls as proof, but nothing in paper writting. It has been 20 days since I moved in.

In the contract, in the "special provisions" section it says that landlord will provide fridge and mantain it functioning. Do I have grounds to break my lease without penalty? Could the text msgs be used as evidence if we went to court?

@Wayne Brooks I guess I will find out in the next few weeks, I'll come back and share my updates as far as how the process goes untill closing. In this case, I opted to use my own tittle co., agree with you on that. Also, I just checked Scheduele B, and everything seems ok, nothing new. 

@Joseph M. Yes, I believe each property you want to bid on, you have to register your credit card for the temporary deposit of 2.5K. Also yes, I paid cash for this property, as soon as I close on it in a few weeks, I will refinance it and repeat the process.
