Thank you. I am documenting everything, emails, texts, communications between contractors, insurance, etc. I need help from somebody on the language and and timing. I want to make sure this is done right. This is a level above what I am used to dealing with.

I had a water leak at a property that required remediation. This was taken care of promptly by a professional remediation company chosen by the insurance company. There is still reconstruction to be completed and that is scheduled. The open drywall areas were covered taped by the remediation company. The opened areas were all very clean. The insurance company sent out a separate company to do mold tests. These all past. The tenant is now claiming a severe allergic reaction to the mold, dust, etc. from open construction areas. He had surgery a few weeks after the remediation was completed and he told us no work could be completed for two weeks for which he then requested another week. We obliged. One day he wrote an email about the mold and dust and claimed the taped up areas had come loose and the plastic was deteriorating. I showed up ten minutes later with tape. He did not answer the door, so I left the tape. I provided a proper notice of entry for a couple days later and he denied me access. I could go on, but simply these are false claims. I am having a hard time getting a lawyer to advise me. I could use some help in dealing with this individual.

This is a SFR. The tenant is due 60 days notice and I am fine with that. I am not a trust, corporation, or LLC. The city/county laws for the most part seem to mirror state law (AB1482) so my current reading is I am exempt from "rent control" and "just cause" requirements.

I have a unit in Chula Vista. The tenant is currently month-to-month. I have non-renewed in the past but with all the changes in laws I thought I would reach out to the community and see if somebody can advise on any gotchas or procedural steps I must take to non-renew my current tenant and stay out of trouble.

3 bed 2.5 bath, approx 1500 sq ft, two stories. The planter outside required both of us for 4+ hours, walls needed scrubbing, oven and behind oven needed serious cleaning, bathrooms needed scrubbing, etc. we chose to do a most of the cleanup ourselves and I want to be reasonable. Maybe another way to ask is what is a fair hourly rate for labor when returning a rental to rent ready condition?

My wife and I have spent the last week and a half cleaning a rental of ours. What is a reasonable rate that can/should be charged for cleaning required to return the unit to rent ready condition (minus normal wear and tear)?

In my opinion this is a case of tenant negligence. The broken handle is a side issue. All this did was cause the chain to get caught in the flap leading to continuous water flow which then drains out. This did not cause the overflow from the toilet that led to the damage in the ceiling. They did have a clog and used a plunger to undo it but obviously they let a fair amount of water overflow and failed to clean it up in a timely manner and I am not sure if they used the shutoff valve which is readily visible. The tenants are elderly and I have a feeling they were unable or unaware of what had happened and the issue was not addressed in a timely manner. I am going to write them a brief polite letter and request they pay for the repairs. If they fight me on it the lease is up in 3-4 months and I will simply not renew it. I cannot keep eating these costs.

Hello all,

I have some tenants who recently clogged the upstairs toilet. In the process they broke the flushing handle and they had an overflow where the water flowed through the ceiling and caused some damage in the ceiling below. We had a plumber come out and their are no leaks or other plumbing issues other than the broken handle on the toilet. This is not the first time these tenants have caused issues with the upstairs plumbing and this is starting to get expensive. Given that they clogged the toilet and allowed the water to overflow which then leaked through the ceiling I believe the cost should be passed on to the tenant. I am in California and have a standard residential 1 year lease with these tenants. They have been good tenants overall but their use/abuse of the plumbing upstairs is getting expensive. 

 I am seeking advise on how to best handle this.
