Without representation usually one party is getting “fleeced” as mentioned above. Usually the seller… But I don’t know anything about the deal, maybe they are getting an amazing price to help a friend.

Yeah, you could use a Title company to help you draft the legal documents.  That would be cheaper.  If there aren't negotiations or any specific terms needed to be drafted by an attorney, do what south NJ does and don't use an attorney.

But again, you are balancing cost vs. risk.

I list auction properties in our MLS for very low $$ because all I need to list and change the status. There are agent/brokers who are reliable.

If you’re in a title company state, they probably have contracts. Otherwise there are plenty of state specific contracts on the internet or through companies like NOLO. 

On a side note. If you think there's a chance you're paying less than 90% of FMV I would get this elderly persons heirs/relatives to sign off on the deal. You don't want to be in court facing elder financial abuse if you "accidentally" tricked a senior in to selling for 20% below fmv. Maybe get an appraisal, they're cheap.

The seller’s niece is involved and will help her look over the contract, so I think we should be fine. The agreed upon price may be a a little below FMV, but definitely not outrageous. That’s good to know though, thanks for the tip!

You're dealing with an elderly family friend here, and that means trust is involved. You don't want to break that trust by screwing up the paperwork. A local attorney with REAL ESTATE experience knows your local laws, knows the industry, and can navigate this deal like a shark in bloody water.

Invest in that attorney and protect both sides of the deal. That's how you WIN. It might cost a little more upfront, but think about the money you're already saving and the value you're creating in the long run.

What’s the best way to draft a purchase agreement without realtors?

I’m attempting to buy a house from an elderly family friend who would like to sell the house to me. We aren’t involving agents, and I need to draft a purchase agreement.

Is my best option to approach a local attorney with real estate experience? My lender suggested going through a local title company’s attorney as that may be cheaper.

I can provide more details if needed. Any suggestions/advice would be appreciated.

If I'm currently receiving MLS listings via email that a realtor set up for me, is it alright if I do not work with the realtor when attempting to go look at these properties?

So I had a realtor set me up with an MLS search where I would receive emails of potential properties in my area daily meeting my criteria. When I talked with him about a year ago, we decided I'd be in a better financial position to purchase a house in about a year. So the past year I've been looking at these properties trying to get a better grasp on my market. Fast forward to now, and my plans have changed slightly. I'm not going to be purchasing a home anymore, but I'm planning on moving into a house with 2 of my college buddies post-grad, and one of their dads is going to buy the property to rent it out to us.

The dad wants my buddies and me to initiate most of the leg work in terms of finding properties and taking visits although he’ll be the one to make the final offer. He’s trying to use it as an opportunity to teach us about the home buying process and help us get some valuable experience.

My dilemma lies in that I don’t feel like I should work with the agent anymore because I’m not myself buying the property. I also haven’t had any communication with the realtor in roughly a year. Is it wrong if I reach out to one of the selling agents myself to view the property?

Any insight would be greatly appreciated. I don’t know if I still have an obligation to my realtor. I want to be professional and not do anything that’s frowned upon in the agent world. Thanks!
