Since this is my first time handling an eviction, I've consulted an attorney to make sure it's done right and will be taking notes along the way to save money in the future. We went ahead and hit them with the 5-day notice to pay or vacate on the 13th and will be filing our Summons & Complaint come 2/20/19 if they do not cure all violations.

@Thomas S. - Sheesh! I feel like I have a decent understanding of the landlord/tenant regulations...I just came here for a little backup and support from someone in the WI area.  I've been fortunate enough to not have to deal with this situation just yet and I wanted to see what BP could provide before I made my move, but I guess those questions aren't warranted here. Love it..NEXT!

@Nicholas Sheridan, Jr. - Correct, we "assumed" the existing lease and their lease expires 4/21/19 and we will not be renewing. Thanks for the info..I am all for assisting where I can but I simply cannot afford to support another family outside my own, especially one that doesn't respect terms of their lease and the property itself. We have 2 other duplexes in the area and haven't had to deal with this type of tenant thus far. I'll probably end up consulting a lawyer in the area...just don't know if it's wise to start the eviction process now or simply wait until their lease expires in few months.

@Jim Cummings @Max T. - Thanks for the info guys. Definitely going to consult a firm in the area and seek some advice.

Hi all, I am in need of some guidance, please. Any direction is much appreciated.

I purchased a duplex in Jan 2018 in Burlington, WI and inherited some bad tenants in the upper unit. Their existing lease with the former landlord prohibited pets, prohibited smoking in the unit, and prohibited unauthorized persons living in the unit.  

I've since learned the following about these tenants...

1) They have 5 small dogs!

2) I have photo evidence of cigarette butts in the unit and communal basement

3) They have adults living in the unit that are not on the lease no approved of by myself or the former Landlord.

4) They owe the former landlord 3 mo of back rent and have not paid me yet for Feb 2019

5) The tenants have now gone silent...they are not returning texts or phone calls

Based upon the above violations, do I, as the new Landlord have the right to terminate the existing lease made between tenant and the former Landlord? If so, do I have to issue a "X Day Notice to Vacate"? Or do I have to honor the existing lease and proceed with eviction?
