Hello, all,

I need your advise again on chapter two of this saga.  I gave her the terms, but she would not sign the terms, but was not going to move in.  I re-listed the house in Zillow, got good traction again, and have 4 showings on Saturday.  

This afternoon, the tenant that broke the lease before moving in, emails me saying, (that she changed her mind and would like to meet this Saturday so she can get the keys to the house).

I have reservations, but not sure if I have a choice.  Although she did not sign the termination agreement, she insisted in writing that she was not moving in and wanted her deposit back.

Any advise...?

I don't have an attorney, but I will be looking for one now to build a relationship with for this and any future Re events.

Thank You, for the response, I am using one of my BiggerPockets Pro benefits, the NY State residential lease agreement.  I believe it covers me enough to take the deposit, because after the signing January 2nd, they expressed that they would not be able to move in till February 1st.  I advised that I would not be able to hold it without a deposit, and they fronted me the 1 month deposit and 1 month security with the signed lease.  I felt comfortable that everything was covered, I was not expecting the tenant to break the contract 5 days before moving in.

In my short conversation, I asked for a written notice, which I received and need to respond to.  

Any further advice will be appreciated.

I am a new Pro member with a question.  If a tenant signed a 12-month lease, I collected and deposited 1-month rent 1-month security, 5 days before moving in the tenant calls to say that they will not be moving in.  What are my options regarding the month's rent and month security now that I have to list again and start the whole process again?
