My partner and I have a duplex under contract. We have a private lender willing to lend to us, although he does want a 1st position lien on the property. Since this is not a hard money loan we will be the ones setting up lien and terms.... How does one go about setting up a lien, and does the investor give us the money directly or does he cut a check to the bank for the Property?

I have an option agreement to buy on a triplex. I gave the seller a down payment on the option, I also keep the rental income from the property in return paying the seller a monthly payment. My question is, since I am not on the deed do I pay the taxes on the income of the property?

@Brandon Sturgill Thanks! No we did not come to any terms, the seller's equity in the property was very low which took owner finance off the table.

Is it possible to give a down payment to a seller who still owes on a mortgage for a property, to then seller finance the rest? Ex. 10k left on the mortgage, 10k down payment, seller now owns free and clear, seller is now able to owner finance.

We use luxury vynal plank floors. They click together and have decent durability. Installation is also fairly strait forward.
