Hi Bigger Pockets Community,

I am looking for advice to help with a bad insurance and water heater situation in my Westminster, Colorado, rental.

Background:  Purchased an upper level condo unit and also purchased a Home Warranty Protection Insurance Product.  When the water heater began leaking I contacted the Home Warranty company as required by them to receive covered service.  One of their contracted electricians came out and determined a new water heater was required.  They then installed a new water heater.  Three weeks later a part popped off of the newly installed water heater causing massive flooding and damage to the unit below me.  My homeowners insurance will not pay, claiming it was a faulty installation that caused the damage (I believe they are correct), the Home Warranty Company is denying any fault, and the home owners insurance from the unit below me says I will soon receive a letter from their property insurance company demanding I pay for the damage.  

Yikes!  

It's time to consult a lawyer for advice, and so I am seeking your help to steer me to a or some Colorado lawyers who have expertise with such issues.

Does anyone out there have a suggestions?

I am your neighbor to the west, having been Bangkok-based for 11 years.  That you have a Vietnamese businesswoman spouse is huge.  In my day job I have a Vietnamese colleague who is an excellent business woman, tenacious as all get-out and able to bring in the business when it counts.  Hardly scientific, but based on my sample survey of 1, I think you have increased your odds of success in HMC by 200% with your partner by your side.  Good luck to you both!

@Mike Freidenberger and @Tyson Luther - Thank you very much for the feedback.  The lease agreement stipulates that the tenants will purchase and replace the filters, but I have actually purchased some and left them conveniently near the furnace to make it easy to replace.  So far it seems to be working, however, I appreciate that when I have more properties and different tenants it may be better for my peace of mind to simple handle this task myself or via property manager.

@Dan Mackin Yes, central A/c is also a feature of the condo unit.

Here I am reaching out to you again.

As a native Coloradan residing in Bangkok for 11+ years I am afraid I am out of touch with how to maintain furnaces.  I believe I misinformed my tenants that 1x per year is adequate. I am now thinking 2x per cold season is actually the correct amount, based on my assumption that a person in the Denver-Metro area is likely only needing their furnace from Nov - May (unless they are super-wimpy like I now am, with tropical blood).  So in a 6-month period of usage 2 filters would be sufficient.  

What do you say, BPers?  I am refining my Lease Agreement requirement with my excellent tenants of my so far only rental unit, in anticipation of a pending 2nd purchase soon.  I just want to give them appropriate guidance.

@Steve Rosenberg - I appreciate your comments and am considering a video walk-through for future tenants.  Though I am a small time landlord at present, I would like to develop a system for this move-out business.  Yes, I would be very happy to receive a copy of your itemized deduction sheet as a sample.  I will follow-up with you directly.  Thanks again!

Hello BP - I am seeking advice and samples for move-out and cleaning instructions to provide my tenants.  My lease agreement informs them that I expect them to do this and I have instructions this, and they have asked me for these very instructions, which I have yet to create.  

Any help with this and/or links to samples that have been previously shared would be greatly appreciated.

The rental unit is a condo.

I will be traveling to Beijing for the first time on a business trip (and am determined to carve out some leisure as well) later this year - I am very excited to finally see it. 

@Brie Schmidt  What a coincidence!  Udan Thani is a nice place, and fun to have the easy opportunity chance to hop across the border to visit the Vientiane, Laos, area.  I have found myself there a couple of times and have a friend living there now.  If you find yourself with some time in Bangkok in January I would love to meet.  Just let me know.

@Mathew Schroeder  Sawatdii kaa & Kap khun kaa- yes, I agree and would love to invest closer to my US Broomfield, CO, home base, however, living in The Kingdom here I feel rather handicapped at my ability to locate deals.   (And yes, I will tell you that my remote research shows me that even within a 1 hour driving distance the pickings seems awfully slim.)  Chok dee ka
