I did not do a title search,but  the son told me the father is on the title.

I was introduced to a family , where the Father passed away.The Mother is not around and there are the children still living in the house. They are still paying the mortgage with the Fathers 401k.They are about to run out of money and won't be able to keep the house.The rest of the family, like aunts and uncles want a piece of the estate.The oldest child is 19.Does he need to open probate in order to sell the house?

Hi Rick.

Does the probate have to be completed first?Can she get the letters testamentary and use that for proof of ownership?

The Lady told me she was the only person to inherit the property. I will ask if she is willing to help relocate her brother, if he is open to speaking with me.Very good advice.

I should offer her a price, without  seeing the inside.Should I write the brother a letter?How much should I give for cash for keys.

I should have looked up the eviction process before asking this question.

I think I will let the home owner handle that.
